Every owner of any structure who rents, leases, or lets one
or more dwelling units or guest rooms on terms, either express or
implied, to furnish heat to the occupants thereof shall supply during
the period from October 1 through May 15 to maintain a room temperature
of not less than 68° F. in all habitable spaces, bathrooms and
toilet rooms during the hours between 6:00 a.m. and 11:00 p.m. and
maintain a temperature of not less than 65° F. during other hours.
The temperature shall be measured at a point three feet above the
floor and three feet from the exterior.
At any time of year when unseasonable weather presents an outside
temperature of 50° F. or under, said owners shall supply heat
in accordance with the above-stated hours.
Any person, firm or corporation who or which shall violate any
provision of this chapter or fail to comply therewith shall, for each
and every violation and noncompliance, forfeit and pay a penalty of
not less than $50 per day, per violation, per dwelling unit, the exact
amount to be left to the discretion of the Magistrate before whom
the complaint is made. The imposition of a penalty for a violation
of this chapter shall not excuse the violation or permit it to continue;
such violation shall be remedied within a reasonable time. The imposition
of the above penalty shall not be held to prevent the enforced compliance
with the provision of this chapter.
