No person shall collect, deposit or transport any type of refuse within the Borough of North Arlington except in closed receptacles or in closed truck bodies covered with a tarpaulin properly anchored. All vehicles so used shall at all times be subject to inspection and approval by the Board of Health and shall be kept and maintained in a clean and sanitary condition and in good working order.
All refuse or other materials collected, deposited or transported within the Borough of North Arlington which shall spill or fall while being carried or conveyed to or by a collection vehicle shall be immediately removed, and the premises or street shall be broom-cleaned so as to leave it in a clean condition.
The owner or owners, or tenant or tenants, of lands and premises situated in the Borough of North Arlington shall remove or cause to be removed from their lands and premises brush, weeds, dead and dying trees, stumps, roots, obnoxious growths, filth, garbage, trash, debris or any unsightly accumulation of earth, within 10 days after notice to remove same. Said notice shall be sent by the Health Department.
In case such owner or owners, or tenant or tenants, of any such lands shall neglect or refuse to remove from such lands brush, weeds, dead and dying trees, stumps, roots, obnoxious growths, filth, garbage, trash and debris within 10 days after notice to remove same, it shall be the duty of the North Arlington Health Department of the Borough to remove or cause to be removed from such lands all brush, weeds, dead and dying trees, stumps, roots, obnoxious growths, filth, garbage, trash and debris.
The cost paid and incurred by such officer of the Borough for removing from such lands brush, weeds, dead and dying trees, stumps, roots, obnoxious growths, filth, garbage, trash and debris shall be by the officer certified to the governing body, which shall examine such certificate and, if found correct, shall cause the cost as shown thereon to be charged against said lands. The amount so charged shall forthwith become a lien upon such lands and shall be added to and become and form part of the taxes next to be assessed and levied upon such land, the same to bear interest for which the same return as taxes, and shall be collected and enforced by the same officers and in the same manner as taxes.
It shall be unlawful for any person or persons to throw or dump any garbage, broken glass, earthenware, tin cans, old iron or any junk of any kind on the open lots or along the streets, roads or highways of this Borough.
The provisions of this chapter and all the rules and regulations promulgated pursuant hereto shall be enforced by the members of the New Jersey State Police Department, Bergen County Police Department, North Arlington Police Department, Health Officer and any employee of the North Arlington Board of Health. Said persons shall have such duties and powers as shall be prescribed by the Board of Health of the Borough of North Arlington and shall have power to issue summonses for any violation of any section of this chapter and other violations of rules and regulations promulgated hereto.
Any person who shall violate any provision of this chapter shall, upon conviction thereof, be punishable by a fine not less than $5 nor more than $500 in the discretion of the Judge, and each day's failure to comply with any such provisions shall constitute a separate violation.
