No person shall sell, deliver or distribute
any soda, beer or other beverages from any wagon, pushcart, truck,
vehicle or other vending device in the streets or from road or open
stands or at fairgrounds, circuses, carnivals, ball fields or other
places where people congregate in the open unless served in bottles
with straws or in individual drinking cups, said straws and cups to
be discarded after one usage.
All foodstuffs sold under such conditions must
be kept in covered receptacles until served and must meet with the
Pure Food Law requirements.
All places or vehicles must be equipped with
satisfactory conveniences for cleansing hands of salespeople.

Any person, persons, firm or corporation intending
to conduct any such business shall first obtain from the Board of
Health a permit for which they shall pay a fee of $5 for each wagon,
pushcart, truck, vehicle or any other vending device, or road or open
stand used in the conduct of any such business mentioned in the preceding
four sections, which permit shall be exhibited in a conspicuous place.
Said permit shall be good for a period of one year and shall expire
on the last day of June of each year and shall not be assignable or
transferable.
All permits issued by this Board may be immediately
revoked and all utensils, appliances, foodstuffs, drinks, etc., may
be immediately confiscated and destroyed by the Health Inspector without
previous notice if the ordinances of the Borough of North Arlington
and the laws of this state are not strictly complied with.

Any person violating or failing to comply with
any of the provisions of this chapter shall, upon conviction thereof,
be punishable by a fine of not less than $5 nor more than $500 in
the discretion of the court. The continuation of such violation for
each successive day shall constitute a separate offense, and the person
or persons allowing or permitting the continuance of the violation
may be punished as provided above for each separate offense.
