For any and every violation of the provisions
of this chapter, the owner or owners, architect or architects, general
agent or agents, contractor or contractors of a building or premises,
or any other person or persons interested as lessee, tenant or otherwise
in any building or premises where such violation has been committed
or shall exist, and any other person who commits, takes part in, or
assists in such violation or who maintains any building or premises
in which any such violation shall exist and who refuses to abate the
violation within five days after written notice has been served upon
him/her or them, either by mail or by personal service, shall for
each and every violation be subject to a fine of not more than $500
at the discretion of the court or judicial officer, before whom a
conviction may be had, or imprisonment in the county jail for a period
not to exceed 30 days, or both. Each and every day that such violation
continues after the notice shall be considered a separate and specific
violation of this chapter.
Nothing in this chapter shall be construed as
depriving the Borough or the Mayor and Council of any other available
remedy.
