The elected Mayor shall be the chief executive and administrative officer of the Town. He shall:
A. 
Enforce the Charter and ordinances of the Town and all general laws applicable thereto.
B. 
Supervise, direct and control all departments of the municipal government and shall require each department to make an annual and such other reports on its work as he may deem desirable. All appointments made by the Mayor will be with the advice and consent of the Council.
C. 
Require each department to make sufficient written reports of its work as he may deem desirable, and the Mayor shall prepare annual written reports relative to the progress of each department, which reports shall be submitted to the Council for its consideration on or before April 15 and October 15 of each calendar year.
D. 
From time to time, make such written recommendations for action by the Council as he may deem necessary in the public interest.
E. 
Submit a written report annually on or before January 15 to the Council and the public on the work of the previous year, on the condition and requirements of the Town government for the current year and with a progress report as to all long-range plans for the municipality.
F. 
The Council shall deal with employees of the Department of Administration and other administrative departments solely through the Mayor or his designee. All contact with the employees and all actions and communications concerning the administration of the government and the provision of municipal services shall be through the Mayor or his designee, except as otherwise provided by law.
G. 
Notify the Council, by written submission to the Municipal Clerk, of any changes in municipal personnel as they occur.
H. 
Be granted the authority to execute regulations to close streets on behalf of the Town of Phillipsburg.
I. 
Require such reports and examine such accounts, records and operations of any board, commission or other agency of municipal government as he deems necessary.
J. 
Prepare and submit to the Council on or before January 15 for its consideration and adoption an annual operating budget and a capital budget, establish the schedules and procedures to be followed by all municipal departments, offices and agencies in connection therewith and supervise and administer all phases of the budgetary process.
K. 
Supervise the care and custody of all municipal property, institutions and agencies and make recommendations concerning the nature and location of municipal improvements and execute improvements determined by the governing body.
L. 
Sign all contracts, bonds or other instruments requiring the consent of the Town.
M. 
Review, analyze and forecast trends of municipal services and finances and programs of all boards, commissions, agencies and other municipal bodies, and report and recommend thereon to the Council.
N. 
Supervise the development, installation and maintenance of centralized budgeting, personnel and purchasing procedures as may be authorized by ordinance.
O. 
Negotiate contracts for the municipality, subject to Council approval.
P. 
Assure that all terms and conditions imposed in favor of the Town or its inhabitants in any statute, franchise or other contract are faithfully kept and performed.
Q. 
Serve as an ex officio nonvoting member of all appointive bodies in municipal government of which he is not an official voting member.
R. 
Have such other functions, powers and duties as are provided by Charter or ordinance.
A. 
The head of each department shall be appointed by the Mayor with the advice and consent of the Council. Whenever he deems it necessary or desirable, the Mayor may appoint an officer or employee of a department to serve as acting head of the department. The Mayor may designate himself as acting head of one or more departments, without additional compensation. He shall not fill said vacancy in the Department of Administration or Finance. Each department head, subject to the direction and supervision of the Mayor, shall:
(1) 
Exercise and discharge such functions, powers and duties as may be allocated and assigned to the department by or pursuant to the Charter or any ordinance.
(2) 
Direct and supervise the work of his department.
(3) 
Organize the activities of the department and allocate and assign functions to its employees.
(4) 
Organize and administer a system to receive and adjust citizens' complaints with respect to services rendered by the Department and to provide or issue to the Mayor a statement of disposition of such complaints within five working days.
B. 
The Mayor shall establish an employee grievance procedure which shall review and adjust as set forth in the Policies and Procedure Manual said grievance which any employee or department head may present. The Council is to be advised of grievances by report from the Mayor.[1]

A. 
The Mayor shall supervise the care and custody of all municipal property, institutions and agencies and make recommendations concerning the nature and location of municipal improvements and execute improvements determined by the Council.
B. 
The Mayor, with the approval of the Council, shall arrange for such insurance and surety coverage as may be required by the Town to protect it against risks of loss from whatever cause. All insurance policies and surety bonds shall be filed for safekeeping with the Town Clerk.
No rule or regulation made by any department shall take effect without written approval of the Mayor or until at least 10 days after it is filed with the Business Administrator. This limitation of time shall not apply, however, to any order, rule or regulation which relates solely to the organization or internal management of the Town government or part thereof. The Business Administrator shall maintain a docket of all orders, rules and regulations filed in his office, which docket shall show the name of the issuing department, a brief description of the subject matter and the date of filing. At the close of each year the Business Administrator shall, with the advice and assistance of the Town Attorney, compile, classify and bind all of the orders, rules and regulations which then remain in force and effect. The Business Administrator may arrange for the printing and sale of such compilation within the limits of available appropriations.
The Mayor may, in his discretion, allocate, assign or delegate functions or powers to a department head for more efficient administration of the Town government, provided that any such delegation, allocation or assignment shall not relieve the Mayor of any of his responsibilities under the Charter or Code, nor shall it be inconsistent with any express requirement of the Charter or Code. Any such delegation shall be in writing and shall be promptly reported to the Council and recorded in its minutes.
As provided by N.J.S.A. 40:69A-42, the Mayor shall designate the Business Administrator, any other department head or the Municipal Clerk to act as Mayor whenever the Mayor shall be prevented by absence from the municipality, disability or other cause from attending to the duties of his office. During such time the person so designated by the Mayor shall possess all the rights, powers and duties of the Mayor. Whenever the Mayor shall have been unable to attend to the duties of his office for a period of 60 consecutive days, for any of the above-stated reasons, an Acting Mayor shall be appointed by the Council who shall succeed to all the rights, powers and duties of the Mayor or the then-Acting Mayor.
A. 
The Council will act by ordinance whenever required by the Charter and whether or not so required with respect to legislative matters. As to all other matters, it will act by resolution, in accordance with the Charter. The veto power of the Mayor, as provided by the Charter, extends only to ordinances.
B. 
On the next business day after the passage of an ordinance by the Council, and before the publication required by N.J.S.A. 40:49-2, the Clerk shall present to the Mayor a certified copy of the ordinance as passed and make a note on the ordinance or on its backer of the date and approximate time it was received by the Mayor. Any ordinance to which the Mayor has affixed his signature or withheld his approval, or which has taken effect without his approval, pursuant to the Charter, shall be returned to the Clerk, and he shall note the date and time of the return and keep it in safe custody as a public record.
The Mayor may attend all meetings of the Council and may otherwise take part in discussions of the Council, but he shall have no vote except in the instance of a tie in the vote to fill a Council vacancy, in which case he may cast the deciding vote.
