As used in this chapter, the following terms shall have the meanings
indicated:
JUNKYARD
Any place where junk material is stored for purchase of the same;
or the keeping of used automobiles not for the purpose of resale or repair;
or any business or place of storage or deposit, whether in connection with
another business or not, which displays or in upon which there is displayed
to the public new, two (2) or more motor vehicles which are unfit for reconditioning
for use as transportation, or used parts of motor vehicles or old iron, metal,
glass, paper, cordage or other waste or discarded material which has been
a part of any motor vehicle, the sum of which parts or material shall equal
in bulk two (2) or more motor vehicles.
No person shall establish, operate or maintain a junkyard as defined
by this section unless he or she shall first obtain a license for such junkyard
from the Mayor and Council of the Borough of River Edge. Licenses permitting
the establishment, operation or maintenance of a junkyard shall be issued
at the discretion of the Mayor and Council of the Borough of River Edge. Said
licenses shall be valid for a period of one (1) year and are renewable upon
application to the Mayor and Council of the Borough of River Edge.
All applications for the license shall be submitted to the Mayor and
Council for approval and shall comply with zoning regulations of the borough.
The application shall be accompanied by a certified check or cash in
an amount as set forth in the Borough Fee Schedule, adopted by resolution
of the Borough Council, on file in the office of the Borough Clerk.
No junkyard may be operated unless the person operates same on at least
two (2) acres of ground and has constructed thereon a fence at least ten (10)
feet and no more than twelve (12) feet in height surrounding the property.
All junkyards that are issued valid licenses from the Mayor and Council
of the Borough of River Edge are required to obtain off-site contamination
insurance or, in the alternative, a bond in the amount of one million dollars
($1,000,000.) to ensure and protect against damage to the area and environment
as a result of toxic contamination.
All junkyards operating under a valid license issued by the Mayor and
Council of the Borough of River Edge are required to contain and store all
motor oil found in vehicles stored in said junkyards for the purpose of recycling.

For a violation of any provision of this chapter, the maximum penalty,
upon conviction thereof, shall be a fine not exceeding one thousand dollars
($1,000.), or imprisonment for up to ninety (90) days, or a period of community
service not exceeding ninety (90) days, or any combination thereof.
