Pools used for swimming or bathing shall be
in conformity with the requirements of this article; provided, however,
that these regulations shall not be applicable to any such pool less
than 24 inches deep or having a surface area less than 250 square
feet, except when such pools are permanently equipped with a water
recirculating system or involve structural materials. For purposes
of this article, pools are classified as private swimming pools or
public and semipublic swimming pools, as defined below.
Every swimming pool constructed prior to the
adoption of this article shall, within 30 days from the adoption of
this article, and every swimming pool hereafter constructed shall,
prior to completion of construction, be completely surrounded by a
fence or wall of suitable construction of not less than four feet
in height which shall be constructed so as not to have openings or
holes or gaps larger than two inches in dimension, except for doors
and gates; and if a picket fence is erected or maintained, the space
between pickets shall not exceed two inches. A dwelling house or accessory
building may be used as part of such enclosure. Said fence or wall
enclosure shall be designed and constructed as to reasonably prevent
any person from gaining access beneath, through or over the same and
shall be provided with one or more substantial gates or doors of the
same height as the fence or wall enclosure. Every gate or door shall
be securely closed and said gate or door shall be locked so as to
prevent unauthorized access to the pool. A natural barrier, hedge,
pool cover or other protective device approved by the governing body
may be used so long as the degree of protection afforded by the enclosure,
gate and latch described herein is maintained.
No swimming pool shall be hereafter constructed
without a permit. Applications for such a permit, accompanied by four
sets of plans and specifications or proper descriptive brochure, shall
be made to the Zoning Officer. The Zoning Officer shall not pass on
the structural features or durability of the pool but shall issue
a permit for the construction or installation of the pool if the plans
and specifications or descriptive brochure complies with the rules
and regulations hereinafter set forth. In the event that the Board
of Health shall formulate rules and regulations designed for the control
of such pools, the Zoning Officer shall not issue a permit until approval
has been received from the Board of Health. The swimming pool permit
is not a substitute or replacement for a building permit. Any pool
construction which comes under the Building Code shall continue to
require a building permit.
No artificial lighting shall be installed, maintained
or operated in such a manner as to be a nuisance or annoyance to neighboring
property.
All pools shall be equipped with a ground fault
interrupter device.
