The governing body of the Township of Stafford
makes the following findings and determinations:
A. Laser beam pointer devices are being used by individuals
in such a manner as to harass, annoy and potentially cause bodily
harm to those receiving contact with the laser beam; and
B. Laser beam pointer devices carry a danger sign stating
"avoid direct eye exposure."

C. The Federal Food and Drug Administration has issued
a warning on the misuse of laser beam pointer devices and the agency's
concern about the promotion of the items as toys for children.

As used in this chapter, the following terms
shall have the meanings indicated:
LASER BEAM POINTER DEVICE
Any hand-held device which emits light amplified by the stimulated
emission of radiation which is visible to the human eye.
PERSON
An individual, partnership, cooperative, association, corporation,
personal representative, receiver, trustee, assignee or other legal
entity.
It shall be unlawful for any person to intentionally
focus, point or shine a laser beam directly or indirectly upon another
person or animal in such a manner as to reasonably cause harassment,
annoyance, alarm or harm to said person or animal.
Any person violating or failing to comply with
any of the provisions of this chapter shall, upon conviction thereof,
be punishable by a fine of not more than $1,000, by imprisonment for
a term not to exceed 90 days, or any combination of fine, imprisonment
and community service as determined in the discretion of the Municipal
Court Judge. The continuation of such violation for each successive
day shall constitute a separate offense, and the person or persons
allowing or permitting the continuation of the violation may be punished
as provided above for each separate offense.
