As used in this chapter, the following terms
shall have the meanings indicated:
IRRIGATION
Controlled dispersion of water from any safe suitable source,
including properly treated wastewater, for the purpose of irrigating
landscape vegetation or the control of dust and erosion on landscape
areas.
IRRIGATION SYSTEM
Any assemblage of components, materials, or special equipment
which is designed, constructed and installed for controlled dispersion
of water from any safe suitable source, including properly treated
wastewater, for the purpose of irrigating landscape vegetation or
the control of dust and erosion on landscape areas, including integral
pumping systems or integral control systems for the manual, semiautomatic,
or automatic control of the operation of these systems.
All Township residents and nonresidential property
owners are encouraged to voluntarily assist in the advancement of
the interest of water conservation by using private wells for irrigation
and nonpotable water needs, which action shall further promote the
purposes of this chapter. Further, Township residents and nonresidential
owners are hereby encouraged to continue use of private wells for
irrigation and nonpotable water needs subsequent to connecting to
the public water system to promote water conservation and the purposes
of this chapter.
All new nonresidential development properties
shall utilize private wells for irrigation and other nonpotable purposes.
The requirement that new nonresidential development properties utilize
private wells for irrigation and nonpotable purposes shall not be
construed to prohibit new or existing residential properties from
utilizing the public water system for irrigation or nonpotable purposes.
If an underground irrigation system is proposed
for nonresidential site or installed for a lawn or landscaped areas,
a rain-sensor shutoff device must be installed and properly maintained
with such system. The shutoff device shall meet the following specifications.
A. The rain sensor shall employ an electromechanical
actuating device designed to cause circuit interruption that temporarily
disables the irrigation controller during periods of significant rainfall.
For purposes of this chapter, "significant rainfall" shall mean 1/4
inch of rain.
B. The rain-sensor device shall be of a suitable grade
of construction such that the rain sensor device can withstand varying
temperatures and inclement weather.
C. The rain-sensor device shall be placed in a suitable
location to prevent the irrigation system from watering in the event
of a significant rainfall.
In order to reduce the demand on the Township's
water system during peak periods of use, no irrigation system connected
to the public water system shall be operated other than between the
hours of 9:00 p.m. and 7:00 a.m.
No cross-connection between the public water
system and a private well source shall be created, implemented or
used. Any person, firm or corporation who creates, implements or uses
a cross-connection between the public water system and a private well
source shall be in violation of this chapter.
Any person, firm or corporation that shall be
convicted of a violation of a provision of this chapter shall, upon
conviction thereof by any court authorized by law to hear and determine
the matter, be subject to a fine not exceeding $1,000 or imprisonment
for a term not exceeding 90 days, or both, as such court in its discretion
may impose. Each day that such violation exists shall constitute a
separate offense.
