There are hereby established and hereby confirmed
the following offices of the Borough of Emerson, which shall have
the powers and perform the duties herein set out:
A. Administrative Assistant.
(1) The Administrative Assistant to the Mayor and Council,
hereinafter called the "Administrative Assistant," shall generally
be the Administrative Assistant to the Borough Administrator and to
the Mayor and Council. The Administrative Assistant shall perform
such duties as from time to time may be assigned or designated to
him/her by the Mayor and Council and/or the Borough Administrator
or any committee thereof or any member thereof, within such committee's
or member's appropriate jurisdiction.
(2) The Administrative Assistant shall in the performance
of all duties act under the direct and immediate control and supervision
of the Borough Administrator and the Mayor and Council and/or any
committee or member thereof within their appropriate jurisdiction.
(3) The Borough Clerk may and customarily should be appointed
the Administrative Assistant.
(4) The Administrative Assistant shall assist the Borough
Administrator as a liaison between the Mayor and Council and all Borough
officials, departments, boards and committees, and he/she shall also
assist the Borough Administrator as liaison between all Borough officials,
departments, boards and committees inter se.
(5) The Administrative Assistant shall be directly under
the supervision of the Borough Administrator and shall perform such
duties and functions as are regularly assigned to him/her by the Borough
Administrator.
(6) The Administrative Assistant shall have, in the absence
or disability of the Borough Administrator, all the Borough Administrator's
rights and be entitled to perform all his/her duties and assume all
his/her responsibilities.

B. Deputy Borough Clerk.
(1) The Deputy Borough Clerk shall have, in the absence
or disability of the Borough Clerk, all the Clerk's powers and rights
and be entitled to perform all his/her duties and assume all his/her
responsibilities.
(2) Whenever the hand and seal of the Deputy Borough Clerk
of this Borough shall appear upon any instrument or document of this
Borough, it shall be conclusively presumed that the Borough Clerk
was absent or incapacitated and the Deputy Borough Clerk executed
and sealed such instruments pursuant to the authority of this article.
C. Deputy Borough Tax Collector.
(1) The Deputy Borough Tax Collector shall have, generally,
all the rights, duties and obligations of the Borough Tax Collector
to be exercised under his/her direct and immediate supervision and
control and to be exercised by the Deputy Borough Tax Collector independently
in the event of the Borough Tax Collector's death, absence or disability.
(2) The Deputy Borough Tax Collector's authority to act
independently shall cease when the Borough Tax Collector returns or
resumes his/her duties or a new Tax Collector is elected or appointed
to fill the vacancy caused by death.
All the offices set out in §
57-10 hereof shall be appointed by the Mayor of the Borough of Emerson with the consent of the Borough Council.
All officers set out in §
57-10 hereof shall be paid compensation at such rates as the Mayor and Council of the Borough of Emerson shall from time to time fix pursuant to law.

The term and compensation of the offices first
appointed under this article shall commence on January 1, 1985.
This article shall take effect immediately after
publication as required by law and shall be retroactive and take effect
as of January 1, 1968, insofar as permitted by law.
