The use and occupancy of all space underneath
sidewalks of streets of the City of Gloversville is hereby prohibited,
except as hereinafter provided for.
The Common Council of the City of Gloversville
may, upon the written application of any property owner owning property
abutting upon any public street in the City of Gloversville, grant
a permit to such owner for the use of the space underneath the sidewalk
in front of his premises to a point three feet from the outside of
the curbline [which shall leave a space underneath the sidewalk, including
the width of curb, of three feet, which shall not be granted for private
use].
Any such permit shall not be granted for a longer
period than one year, subject to renewal by application for further
periods of one year. Any permit may be revoked by the Common Council
upon 30 days' notice. Upon revocation of any such permit, the property
owners shall immediately put said portion of the street in the same
condition as it was before the permit was granted.

Upon the granting of such permit for the use
of space underneath the sidewalk, the construction of the sidewalk
and all walls with reference thereto shall be carried out according
to City laws regulating the construction of sidewalks and, in addition
thereto, such special provisions and regulations as may be determined
by the Common Council.

Any person violating any provision of this article
may be punishable by a fine of not less than $50 nor more than $250
or imprisonment for a period not exceeding 15 days, or both.
