The C-3 Industrial and Commercial District is
established to provide locations for commercial and industrial activities
in the areas of the Township suitably located. This district is intended
to ensure adequate light, air, open space and other amenities appropriate
to the maintenance of safety and to guarantee qualities conducive
to viable commercial and industrial operations.
The following uses shall be permitted:
A. Uses permitted in the C-1 and C-2 Districts as specified in §§
190-34 and
190-40 of this chapter.
The following accessory uses shall be permitted
in conjunction with authorized uses in the C-3 District: uses which
are customarily incidental and accessory to permitted uses or conditional
uses and necessary for the operation thereof.
The following conditional uses may be permitted, subject to the issuing of a conditional use permit in accordance with the provisions of Article
XIV of the Township Zoning Ordinance and the standards and criteria listed herewith:
A. Adult-related business. Adult-related businesses may
be permitted pursuant to the following criteria and standards:
(1) The building or buildings utilized for the adult-related
business shall be set back as follows (all distances include such
uses in adjacent municipalities):
(a)
The building shall be at least 500 feet in any
direction from any residential zoning district line;
(b)
The building shall be at least 500 feet in any
direction from any residential dwelling (including multifamily buildings),
also at least 500 feet from any public park property;
(c)
The building shall be at least 1,000 feet in
any direction from any school property, church property, preschool
property or child day-care center property;
(d)
The building shall be at least 500 feet in any
direction from any hotel or motel; and
(e)
The building shall be at least 2,500 feet in
any direction from any other building which is utilized for any other
adult-related business which is defined in this chapter.
(2) All activities pertaining to adult-related business
shall be conducted entirely within the confines of the building. No
theater which shows adult-related films shall project the film outside
the confines of the building. No activity or film may be visible from
outside the building. No music or sound emitting from the business
shall be audible to normal hearing at any time at any exterior property
line of the business.
(3) The following hours of operation shall be adhered
to by all adult-related businesses:
(a)
No adult-related business shall be open from
12:00 midnight to 10:00 a.m. daily.
(b)
No adult-related business shall be open on Sundays
and holidays.
(4) The maximum gross floor area of any building which
is utilized for an adult-related business shall be 5,000 square feet.
(5) No exterior sign which advertises any adult-related business shall include any lewd or obscene work or any figure, picture or painting which utilizes sexually explicit graphics. Otherwise, signs shall be limited to the provisions specified in Article
XVI of this chapter.
(6) Off-street parking shall be provided at the rate specified in Article
XVII of this chapter.
(7) Proposed landscaping and other required site improvements
will be specified as part of the conditional use permit.
(8) All proposed exterior lighting will be approved as
part of the conditional use permit. All proposed lighting shall be
such that it does not affect neighboring properties.
(9) To ensure that the regulations of this section are
adhered to by the applicant, the following information shall be provided
with the application for a conditional use:
(a)
A site survey of the property and building proposed
for the adult-related business and a survey illustrating the distance
to the location and the size and type of all buildings and uses within
2,500 linear feet of the building proposed for the adult-related business.
The survey must be completed by a registered professional engineer
or a registered professional land surveyor. Also, the zoning district
classification within 2,500 feet of the property and building proposed
for the adult-related business shall be illustrated on the site survey.
The survey shall be prepared and sealed by a surveyor licensed by
the Commonwealth of Pennsylvania and shall be at a scale no less than
one inch to 100 feet. The survey shall indicate the scale, date drawn,
North point and tax parcel number of all parcels illustrated and shall
be on paper measuring 24 inches by 36 inches. Fifteen copies of the
survey shall be submitted with the application.
(b)
The above-referenced site survey shall indicate
the proposed parking layout, landscaping, lighting, sign location,
building location and any other exterior improvements.
(10)
The Board of Commissioners may impose additional
conditions on an applicant proposing an adult-related business in
order to promote the general health, safety and welfare of the community.
The following lot, area and dimensional requirements
shall apply in the C-3 District:
A. Minimum lot area shall be 16,000 square feet.
B. Minimum lot width shall be 80 feet at the building
line.
C. Minimum front building line setbacks shall be 20 feet.
D. Minimum side yard width on each side of the lot shall
be 15 feet. The minimum side yard width on the street side of a corner
lot shall be 20 feet.
E. Minimum rear yard depth shall be 20 feet from the
rear lot line.
F. Not more that 85% of the total site shall be covered
by structures.
G. No structure shall exceed three stories or 50 feet
in height.
