Conditional uses may be permitted by the Township Commissioners, consistent with the provisions of Article
VI of the Pennsylvania Municipalities Planning Code and pursuant to express standards and criteria set forth in this chapter.
The following procedures shall govern the granting
of conditional uses in Patterson Township, Beaver County, Pennsylvania:
A. Property owners desiring approval for a conditional
use, pursuant to express standards and criteria set forth in this
chapter, shall provide a written request for such approval to the
Planning Commission not less than 10 days prior to the regularly scheduled
meeting of the Commission.
B. The request shall specify the intended uses and purposes
for which the conditional use approval is being made. Further, the
formal request shall document the manner in which the developer will
meet the standards and criteria specified in the ordinance for the
conditional use.
C. The property owner shall provide the Planning Commission
with documentation to indicate the attitudes of adjacent and area-wide
property owners within 250 feet of the property to be developed, as
they relate to the proposed conditional use.
D. The Planning Commission shall consider written requests for conditional uses and transmit its recommendations to the Township Commissioners within 45 days of the date of the regular meeting following receipt of the request as provided in Subsection
A above. The Planning Commission may request the property owner to provide additional information or to appear before the Commission to discuss the request. The Planning Commission may conduct public hearings on the request for the purpose of assembling additional input from the community at large.
E. The forty-five-day review period may be extended by
the mutual agreement of the affected parties.
F. The Township Commissioners shall hold a public hearing
on the request for conditional use within 60 days following the date
of the regular meeting at which the recommendation of the Planning
Commission is received. The Township Commissioners may request additional
data and/or documentation during their consideration of the request
for approval of a conditional use.
