This chapter shall be known and may be cited as the "Sunbury Land Subdivision Regulations."

This chapter is adopted pursuant to the provisions of the Pennsylvania Municipalities Planning Code, as amended,[1] for the purpose of ensuring sites suitable for building purposes and human habitation, and to provide for the harmonious development of the City of Sunbury, Northumberland County, Pennsylvania, for adequate open spaces, for traffic, recreation, light and air and for the proper distribution of population, thereby creating conditions favorable to the health, safety, morals and general welfare of the citizens of the City; to regulate the subdivision and/or development of flood-prone land areas; to require that each subdivision lot in flood-prone areas be provided with a safe building site with adequate access and that public facilities which serve such uses be designed and installed to preclude flood damage at the time of initial construction; and to protect individuals from buying lands which are unsuitable for use because of flood hazards by prohibiting the subdivision and/or development of unprotected flood-prone lands.

As used in this chapter, the following terms shall have the meanings indicated:
100-YEAR FLOOD
A flood that has one chance in 100 or a 1% chance of being equaled or exceeded in any year. For the purposes of this chapter, the 100-year flood (base flood) as defined by the Federal Insurance Administration, United States Department of Housing and Urban Development, in the Type 15 Flood Insurance Study for the City of Sunbury, Pennsylvania.

BASE FLOOD ELEVATION
The 100-year-flood elevation.

BUILDING LINE
A line parallel to the front, side or rear lot line set so as to provide the required yard.
CARTWAY
The area of a street, road or alley used for vehicular traffic.
CLEAR SIGHT TRIANGLE
The area of unobstructed vision at street intersections, defined by lines of sight between points at a given distance from the intersection of street center lines.
COMMISSION
The Planning Commission of the municipality.
CUL-DE-SAC
A street open at one end for vehicular or pedestrian access, with the opposite end terminating in a vehicular turnaround.
DWELLING
A building designed for residential purposes and used as the living quarters for one or more families.
DWELLING, GROUP
A group of two or more single-family, two-family or multifamily dwellings occupying a lot in one ownership.
DWELLINGS, MULTIFAMILY
A building used by three or more families living independently of each other and doing their own cooking, including apartment houses.
DWELLING, SINGLE-FAMILY ATTACHED (ROW)
A building used by one family and having two party walls in common with other buildings.
DWELLING, SINGLE-FAMILY DETACHED
A building used by one family, having only one dwelling unit and having two side yards.
DWELLING, SINGLE-FAMILY SEMIDETACHED
A building used by one family, having one side yard and one party wall in common with another building.
DWELLING, TWO-FAMILY DETACHED
A building used by two families, with one dwelling unit arranged over the other, and having two side yards.
DWELLING, TWO-FAMILY SEMIDETACHED
A building used by two families, with one dwelling unit arranged over the other, having one side yard and one party wall in common with another building.
DWELLING UNIT
One or more rooms used for living and sleeping purposes and having a kitchen with fixed cooking facilities arranged for occupancy by one family.
EASEMENT
A right granted to use certain land area for a special purpose consistent with the general property rights of the owner.
ENGINEER
A registered engineer retained by the municipality, authorized to practice engineering as defined by the Registration Act of the Commonwealth of Pennsylvania.[1]
ENGINEERING SPECIFICATIONS
The engineering specifications of the municipality regulating the installation of any required improvements or for any facility, installed by an owner, subject to public use.[2]
FLOODPROOFING
Any combination of structural and nonstructural additions, changes or adjustments to properties and structures, which reduce or eliminate flood damage to lands, water and sanitary facilities, structures and contents of buildings.

GOVERNING BODY
The elected officials of the municipality.
HEALTH OFFICIAL
Sanitarian of the State Department of Health, local Health Officer or other qualified personnel.
LOT
A lot or parcel of land which is, or in the future may be, offered for sale, conveyance, transfer or improvement.
LOT AREA
Area contained within the property lines, excluding street area, but including the area of any easement.
LOT, DOUBLE-FRONTAGE
A lot, the opposite ends of which abut on streets.
LOT, REVERSE-FRONTAGE
A lot between an arterial street and a minor street, with vehicular access only from the minor street.
LOT WIDTH
Width of a lot measured at the building setback.
NEW MOBILE HOME PARK OR MOBILE HOME SUBDIVISION
A parcel or contiguous parcels of land divided into two or more mobile home lots for rent or sale for which the construction of facilities for servicing the lot on which the mobile home is to be affixed (including, at a minimum, the installation of utilities, either final site grading or the pouring of concrete pads, and the construction of streets) is completed on or after the effective date of floodplain management regulations adopted by a community.

PERSON
Any individual or group of individuals, partnership, copartnership or corporation.
RIGHT-OF-WAY, STREET
A strip of land between property lines for use as a road, street or alley.
SANITARY SEWER
A pipe for conveying sewage, and excludes stormwater, surface water and groundwater.
STORM SEWER
A pipe for conveying rainwater, surface water, condensate, cooling water and similar liquid waste, exclusive of sewage or industrial waste.
STREETS
Public rights-of-way for vehicular or other traffic, whether designated as streets, highway, thoroughfares, parkways, throughways, roads, avenues, boulevards, lanes, places or alleys, or however other designated, and for the purpose of this chapter shall be classed as follows:
A. 
PRIMARY STREETSStreets which traverse through the municipality and are used primarily for through, fast or heavy traffic.
B. 
SECONDARY AND COLLECTOR STREETSStreets which carry traffic from minor streets to the major system of primary streets, including principal entrance streets of a residential development and streets for major circulation within such developments.
C. 
MINOR STREETSStreets used primarily for access to the abutting properties.
D. 
MARGINAL ACCESS STREETSMinor streets which are parallel to and adjacent to primary streets and which provide access to abutting properties and protection from through traffic.
E. 
ALLEYSMinor ways which are used primarily for vehicular service access to the back or the side of properties otherwise abutting on a street.
STREET WIDTH
The shortest distance between the lines delineating the right-of-way of a street.
SUBDIVIDER
A person, copartnership or corporation owning land in the municipality and for which a land subdivision application is filed and processed under the provisions of this chapter.
SUBDIVISION
The division of a single lot, tract or parcel of land, or part thereof, into two or more lots, tracts or parcels of land, including changes in street lines or lot lines, for the purpose, whether immediate or future, of transfer of ownership or of building development; provided, however, that divisions of land for agricultural purposes in parcels of more than 10 acres, not involving any new street or easement of access, shall not be included within the meaning of "subdivision." The term includes resubdivision and, when appropriate to the context, shall relate to the process of subdividing or the land subdivided.
SURVEYOR
A registered surveyor, as defined by the Registration Act of the Commonwealth of Pennsylvania.[3]
