The Municipal Court of the Township, heretofore
established as of January 1, 1949, in accordance with applicable law
(now N.J.S.A. 2B:12-1 et seq.), is hereby continued.
The name of the Municipal Court shall be the
"Municipal Court of the Township of Toms River."
The Municipal Court shall have an official seal
which shall bear the impress of the name of the Court.
The Municipal Court of the Township shall have
two Judges who shall be appointed by the Mayor with the advice and
consent of the Township Council. Said Judges shall have the qualifications
required by law. The Judges shall each serve terms of three years
from the date of appointment and until their successors are appointed
and qualified.
Judges of the Municipal Court shall be compensated
by an annual salary as established by Township Council. This compensation
is in lieu of any and all other fees.
The Municipal Court and the Judges thereof shall
have, possess and exercise all the jurisdictions, powers, functions
and duties which are or may be conferred by law and the applicable
rules of the Supreme Court of New Jersey.
There shall be a Court Administrator who shall
be appointed by the Mayor with the advice and consent of Township
Council. The Court Administrator shall serve for a term of three years
from January 1 of the year in which he or she is appointed and until
a successor is appointed and qualified. The Court Administrator shall
receive such compensation as established by Township Council. The
Court Administrator shall supervise and administer the work of the
Municipal Court, subject to the direction of the Judges and applicable
statutes and Court rules, and act as the Clerk of said Court according
to statute and the rules of Court.
For violations of Title 39 of the New Jersey
Revised Statutes, municipal ordinances and violations of state law
which are subject to Municipal Court jurisdiction, the Municipal Court
is authorized, at its discretion, to charge court costs up to, but
not exceeding, the maximum amount as is permitted by N.J.S.A. 22A:3-4.
For every such violation, all costs assessed pursuant to N.J.S.A.
22A:3-4 which are payable to the State of New Jersey shall not be
suspended and must be collected by the Municipal Court and transmitted
to the applicable state fund.

A. All requests for discovery in matters pending in the Township of
Toms River Municipal Court must be submitted through the Municipal
Prosecutor.
B. Discovery requests are subject to the fees set forth in Rule 7:7-7(i)
of the New Jersey Rules of Court and any amendments or supplements
thereto.
