As used in this chapter, the following terms shall have the
meanings indicated:
FOOD STAND, OUTDOOR
A retail or commercial booth, stall or counter, whose primary
trade is the preparation and sale of cooked or uncooked food or beverages
for contemporaneous consumption, but which does not provide adequate
indoor seating for the use of its patrons.
OUTDOOR RESTAURANTS
A retail or commercial establishment for the preparation
and sale of cooked or uncooked food or beverages served to customers
for consumption on premises, and which contains adequate outdoor seating
for the use of those customers.
No outdoor food stand, as defined in this chapter, may be open
for business between the hours of 2:00 a.m. and 6:00 a.m.
No outdoor restaurant, as defined by this chapter, may be open
for business between the hours of 2:00 a.m. and 6:00 a.m.; provided,
however, that a restaurant which contains both indoor and outdoor
seating may continue to operate during these hours if it limits customers
to the indoor seating, which must be reasonably adequate to accommodate
all customers at any given time.
Any violator of this chapter shall be subject to a fine of not
less than $100 and not more than $500.
