After the effective date of this article, the local Board of Health of the Township of Toms River, in the County of Ocean, shall appoint a Plumbing Inspector.
The annual compensation of said Plumbing Inspector shall be the sum of $4,000 per annum,[1] to be paid in equal semimonthly installments in the same manner and form and at the same times that other municipal employees are paid.

The said Plumbing Inspector shall be charged with the duty of and the responsibility for the enforcement of any and all ordinances relating to plumbing within the territorial jurisdiction of this Board and such other duties relating to plumbing matters as shall from time to time be assigned to said Plumbing Inspector by this Board.[1]

Pursuant to N.J.S.A. 26:3-1 et seq. and especially N.J.S.A. 26:3-19, the Board of Health hereby creates and establishes the title and position of Health Officer.
The Board of Health may appoint a Health Officer, who shall serve a term of not more than three years as determined by resolution of appointment.
The salary, compensation and conditions of employment of the Health Officer shall be established by resolution of the Board of Health, and said salary shall be within a range of $18,000 to $28,000 per annum, based on skill, education, experience and responsibilities.[1] All employee and personnel benefits, rules, regulations and policies of the Board of Health relating to vacation, sick leave, holidays and other fringe benefits, as they now exist or may hereafter be amended, shall apply to the Health Officer, except the benefits of annual salary increments.

The Health Officer must hold a valid license of a Health Officer issued by the State of New Jersey.
Dismissal of the Health Officer shall be in accordance with state statute and ordinance governing employee regulations of the Board of Health or of Toms River Township.
A. 
The Health Officer shall devote his time during regular business hours of the Township to the performance of his official duties, as well as such additional time that may be directed. The Health Officer shall be subject to the supervision of and be responsible to the division head and members of the Board of Health. The Health Officer shall be a full-time employee of the Board of Health and may not hold any government title or position not under the full authority of the Board, nor engage in any non-Township employment or activities for remuneration without specific authorization of the Board of Health.
B. 
The Health Officer shall be the general agent of the Board of Health and shall enforce all provisions of the ordinances, resolutions, rules, regulations and directives of the Board of Health, all health ordinances of Toms River Township, all statutes and regulations of the State of New Jersey, including the standards of performance of the Local Health Services Act (N.J.S.A. 26:3A2-1 et seq.), and carry out such administrative duties as shall be assigned.
C. 
The Health Officer is authorized to issue summonses and prosecute violations for and on behalf of this Board in the Municipal Court of Toms River Township.
All the terms and provisions of this article shall apply to any person currently holding the title or position of Health Officer of the Board of Health by virtue of a duly passed resolution of the Board.
