A.
The Town Board finds that New York Town Law § 271(15)
permits the Town to establish the position of alternate member of
the Planning Board to substitute in the event that a member has a
conflict of interest.
B.
The Town Board further finds that, pursuant to Municipal
Home Rule Law § 10, the Town Board may expand the authority
of such alternate member to substitute in the event of absence or
illness of a Planning Board member.
C.
Therefore, it is the purpose of this article to establish
the position of alternate member of the Planning Board to assist applicants
and the Planning Board to operate effectively in the event of a conflict
of interest, or absence or illness of one member of the Planning Board.
A.
The position of alternate member of the Planning Board
is hereby created.
B.
In addition to substituting in the place of a Planning
Board member who cannot participate because of a conflict of interest,
the alternate Planning Board member may also substitute for a Planning
Board member who is absent for any reason, including but not limited
to illness, absence from the jurisdiction or engagement elsewhere.
This article is enacted pursuant to the authority
contained in Municipal Home Rule Law § 10(1)(i) and (ii)(a)(1)
and (3) and is intended to amend and expand the circumstances under
which an alternate member of the Planning Board may serve.
