As used in this chapter, the following terms
shall have the meanings indicated:
PEDDLER
Any person over 16 years of age, whether principal or agent,
who shall go from place to place within the Town selling or bartering
or carrying for sale or barter or exposing therefor any goods, wares
or merchandise, either on foot or from any animal or vehicle.
SOLICITOR
Any person over 16 years of age, whether principal or agent,
who shall go from place to place within the Town soliciting orders
for future delivery of any goods, wares, or merchandise, including
magazines and other printed matter.
The provisions of this chapter shall not apply
to persons who are soliciting orders of purchase for future delivery,
selling, bartering or exposing for sale or barter goods, wares or
merchandise to regularly established customers; to salesmen selling
goods to retail or wholesale stores for resale; or to industrial establishments
for processing; to sales by farmers and gardeners of the produce of
their farms and gardens; or to the sale, distribution and delivery
of milk, teas, coffees, spices, groceries, meats and bakery goods;
or to newsboys and those exempted under the General Statutes of the
State of Connecticut from the operation of the general regulatory
power given to towns with respect to hawking and peddling.
Every person desiring to solicit or peddle upon
the streets of the Town of Haddam, except those exempted herein, shall
complete an application blank provided by the Selectmen of the Town
for a solicitor's or peddler's license. Upon the filing of such application
the Selectmen shall require the applicant to give information concerning
his place of residence, his physical description and business and
a statement as to whether or not he has been convicted of any crime.
When said application shall be approved by the
Selectmen, they shall refer the applicant to the Town Clerk, who shall
issue the license applied for as follows: a solicitor's license for
a period of 30 days upon the payment of a fee of $5, or a peddler's
license for a period of one year upon the payment of a fee of $25,
for each team or vehicle used in connection with such peddling, vending
or hawking.
No person engaged in the business of soliciting
or peddling shall solicit or peddle any goods of any description in
the public streets within 200 feet of any school, and no person shall
create a disturbance in the public streets by the continued blowing
of horns or other sound-producing devices, but may make a signal on
any street reasonably loud enough to attract the attention of customers
in the immediate vicinity.
Any person violating any of the provisions of
this chapter or making any false statements or misrepresentations
of fact for the purpose of obtaining a license to solicit or peddle
shall, upon conviction thereof, be subject to a fine of not more than
$50 or to the revocation of his license to solicit or peddle, or both.
