The Commission, at its discretion, or upon written
request from the applicant, may waive specific requirements of these
regulations with respect to a particular subdivision where, owing
to conditions especially affecting such subdivision, a literal enforcement
of these regulations would result in practical difficulty and unusual
hardship or undesirable land development, so that substantial justice
will be done and the policy and intent of these regulations will be
preserved. No waiver shall be granted that would have a significant
adverse impact on adjacent property or on public health and safety.
Approval of any waiver requires a three-fourths vote of all members
of the Commission. Reasons for any waiver shall be so stated in the
vote.
Where a proposed subdivision involves establishment
of not more than five lots, where such lots front on an existing street,
the Haddam Planning and Zoning Commission may vote to waive the required
submission of a site development plan and/or grading plan, and/or
stormwater runoff control plan in any area of the Town, and/or erosion
and sedimentation control plan, and/or cutting plan in areas outside
the Gateway Conservation Zone only. Where a proposed subdivision or
resubdivision does not involve more than $2,000 of street, drainage
or other improvement construction, the Commission may vote to waive
the required submission of construction plans as provided in §
302-10D.
The Commission may waive the required submission of a site development
plan in connection with any resubdivision.
