A. 
The International Building Code, 2021 edition, and, as applicable, the International Residential Code, 2021 Edition including IBC Appendix I (Patio Covers) and IRC Appendix AE (Manufactured Housing used as Dwellings), AH (Patio Covers), AJ (Existing Building and Structures), are hereby adopted by reference as the Building Code and Residential Code of the Town of Bethany Beach. Part 3, Permits, of this Chapter 395, Building Construction, and Chapter 453, Flood Damage Prevention, of the Town Code shall govern the issuance of building permits in the event of any conflict between said provisions and the provisions of the International Building Code and the International Residential Code as adopted by reference by this § 395-1.
B. 
The following sections of the International Building Code, 2021 Edition, are hereby revised as follows:
(1) 
Section 101.1. Insert: Town of Bethany Beach.
(2) 
Section 202 Definitions, Wind-Borne Debris Region:
(a) 
Subsection (1). Delete: 130 mph; insert: 110 mph.
(b) 
Subsection (2). Delete: 140 mph; insert: 120 mph.
(c) 
Add : High-impact glazing and other methods of protection for glazed areas in high wind-borne debris regions not required.
(3) 
Section 1612.3. Insert: Town of Bethany Beach.
(4) 
Section 1612.3. Insert: March 16, 2015.
C. 
The following sections of the International Residential Code, 2021 Edition, are hereby revised as follows:
(1) 
Section R101.1. Insert: Town of Bethany Beach.
(2) 
Table R301.2(1). Insert: 110 mph (basic wind speed).
(3) 
Section R322.3.2. Elevation Requirements 1.2. Change: requirement for elevation to be Base Flood Elevation plus 18 inches.
(4) 
Section R313.2. One- and two-family dwelling automatic sprinkler systems. Delete: shall; insert: may.

For any violation of the provision of this code, the owner, general agent or contractor of a building or premises where such violations have been committed or shall exist and the lessee or tenant of an entire building or entire premises where such violations have been committed or shall exist and the owner, general agent, contractor, lessee or tenant of any part of a building or premises in which such violation has been committed or shall exist and the general agent, architect, builder, contractor or any other person who commits, takes part or assists in any such violation or maintains any building or premises in which such violation shall exist, upon conviction thereof, shall be guilty of a violation of this code and shall be punished by a fine as set out in Chapter 1, General Provisions, Article I, Penalties. Each day any violation of any provision of this code occurs or continues to exist shall constitute a separate violation and shall be subject to a separate fine as above provided and the cost of prosecution.
Any building or portion thereof or party or foundation wall hereafter erected or placed upon any lot or premises within the Town in violation of the provisions of the Building Code is hereby declared a common nuisance and shall be abated in the manner provided by the Building Code or as may otherwise be provided by state law.
