In accordance with § 10(1)(ii)(a)(9-a)
of the Municipal Home Rule Law of the State of New York, the Monroe
County Office of Probation-Community Corrections is hereby authorized
to fix, levy, collect and administer the administrative fees described
below, and is further authorized to increase said fees collected in
accordance with annual increases incurred in the costs of administering
the related programs and services.
A. Electronic monitoring fee: collection of an administrative
fee equal to the daily rental cost of electronic home confinement
units. The current cost is $4.06 per day for each home confinement
unit per probationer.
B. Victim impact panel fee: an administrative fee for
attendance at DWI victim impact panels, which is currently proposed
at a rate of $20 per user, per session.
C. Sex offender polygraph fee: an administrative fee
equal to the contractual charges for administering polygraph examinations,
presently a maximum of $200 per family history test; $150 for maintenance/monitoring
test; $150 for instant-offense test; and $50 for failure-to-show test.
Payment of the above fees shall be waived for
those probationers who meet the indigent eligibility criteria of the
Monroe County Office of Probation-Community Corrections.
All administrative fees are retained by the
County of Monroe and are excluded from consideration by the New York
State Division of Probation and Correctional Alternatives when determining
state aid reimbursement pursuant to § 246 of the New York
State Executive Law.
