Heretofore and on October 11, 1976, there was duly adopted by
the Village of Russell Gardens, effective November 1, 1976, the "Fire
Prevention Code of the State of New York" for the purpose of prescribing
regulations governing conditions hazardous to life and property, a
copy of which code is now on file in the office of the Village Clerk.
The said code is hereby incorporated by reference as is fully set
out at length herein and all of its provisions shall be controlling
within the Village of Russell Gardens, except as supplemented by this
chapter, it being intended that if the provisions of this chapter
are more stringent than said code, this chapter shall prevail.
The provisions of the State Fire Prevention Code and of this
chapter shall be administered and enforced by the Village Board and/or
its designee. For the purposes of this chapter, the Village Board
hereby designates the Building Inspector as Fire Marshal, who shall
recommend to the Village Board any action to be taken to enforce the
aforesaid provisions.
To lessen the danger of fire, the Village Board may direct the
substitution and/or elimination of plastic material, or any derivative
thereof, in any form, for use in construction or alteration work,
provided that the material directed to be substituted for said plastic,
in the judgment of the Village Board, shall be deemed safer, from
a fire prevention standpoint, than plastic or any derivative thereof.
It is hereby declared to be the policy of the village to maintain
a reasonable degree of purity of its air resources. Therefore, the
provisions of Local Law No. 1-1967 of the County of Nassau, now in
force, as applicable to said county, shall be deemed applicable to the Village of Russell Gardens, and its officials shall cooperate with the Nassau County Department of Health, Air Pollution Control Unit, to enforce the provisions of said local law of the County of Nassau without prejudice or affecting the independent right of Nassau County to enforce said local law within the Village of Russell Gardens. The village authorities may nevertheless enforce said local law, upon proper prior notice to the county, and the penalties prescribed in Chapter
1, General Provisions, Article
III, Penalties, may be imposed upon any violators of said local law within the village.
Any person committing an offense against any provision of this chapter or of the State Fire Prevention Code shall be punishable as provided in Chapter
1, General Provisions, Article
III, Penalties.
