Within the waters under the jurisdiction of the City of Glen Cove, no person shall construct, erect or alter any structure or dredge, fill or alter the shoreline or permanently place any object, floating or submerged, except that which shall be in conformity with the provisions herein contained or except as hereinafter provided.
A. 
Application; fee. Before commencing to construct, erect or alter any structure or to dredge, fill or alter the shoreline or permanently place any object, floating or submerged, the owner or proprietor or duly authorized agent of either of them shall submit an application to the Harbormaster. The application for a permit shall be in writing, accompanied by maps, plans and sketches of the proposed work and shall be addressed to the Harbormaster, c/o City Clerk, City Hall, City of Glen Cove, New York. The fee as set forth from time to time by the City Council,[1] shall accompany the application, payable to the City of Glen Cove.

B. 
Contents of applications.
(1) 
The application shall:
(a) 
Include completion of forms provided by the Harbormaster.
(b) 
Include the plans and detailed explanation necessary to enable the Harbormaster to determine exactly what is proposed.
(c) 
Show that the structure is not likely to fail and become a danger or obstruction to navigation or injure the navigable capacity of any of the waters under the jurisdiction of the City of Glen Cove.
(2) 
If dredging or dumping is proposed, the application shall give the following:
(a) 
The exact location of the work.
(b) 
The depth to which the proposed dredging is to be carried.
(c) 
The approximate amount of material to be removed.
(d) 
The exact location of the deposit of the dredged material.
(e) 
The depth to be left over it.
(3) 
Where dredging or dumping is proposed in connection with other work, a separate application for dredging shall not be required, but the above information shall be included in the application.
(4) 
The application, attached papers and maps shall be complete, without reference to other correspondence not attached, and shall include any special authorization for the work that is prerequisite to the action of the Harbormaster, as, for example, a copy of the state permit for the work if the laws of the state require the same.
(5) 
The application shall be signed by the owner or proprietor of the proposed work, or by his or her duly authorized agent, and not by the contractor to perform the work. The application shall be submitted in duplicate, and all attached papers shall be furnished in duplicate.
The Harbormaster shall transmit all applications under this article to the Harbor and Waterfront Development and Conservation Commission for its review and recommendations to the City Council.
The duplicate copy of the application with the approval of the City Council, after review and recommendation of the Harbor and Waterfront Development and Conservation Commission, shall constitute the permit. The City Council, at its discretion, may require a performance and completion bond.
The provisions of this article shall be enforced by the Harbormaster, his or her Deputies, or any police officer or peace officer when operating pursuant to their special duties or by any other duly appointed law enforcement officer of the City of Glen Cove.
