The operation of dog kennels in the City of North Tonawanda,
New York, shall comply with and be subject to the following rules
and regulations:
A. The
kennel yard or area where dogs are kept shall be enclosed by a securely
constructed wire fence not less than six nor more than seven feet
in height.
B. The
doorways or entrance or exit gates to and from such kennel area shall
be of a self-closing-type construction and shall be so hinged and
stopped as to swing into the kennel when opened.
C. No
kennel shall be constructed closer than 100 feet from the front property
line and not closer than 20 feet from any side or rear property line.
D. Each
kennel shall be equipped with housing or shelter facilities sufficient
to provide adequate cover and shelter for all dogs which may be housed
in the kennel.
E. Runways
located within the kennel shall be operated by wire fence not less
than four feet in height.
F. Kennels
shall be cleaned daily and shall be kept in such condition that no
odors shall emanate therefrom.
G. For
each dog housed in the premises being over six months of age, there
shall be provided a minimum of 80 square feet of runway area.
H. No
dog housed and maintained in any kennel in the City of North Tonawanda
shall be permitted to be out of doors and to bark between the hours
of 10:00 p.m. and 8:00 a.m. of each twenty-four-hour period.
I. Under
no circumstances shall dogs be housed or maintained on the premises
where a kennel is in operation tethered or tied to a tree or other
object outside the kennel area.
J. Dog
registration fee for each dog over six months of age be $2.
The owner or operator of any such kennel licensed under the
provisions of this ordinance shall pay an annual fee to the City of
North Tonawanda in the amount of $50. Such fee shall be paid at the
office of the City Clerk and shall be due on or before January 1 of
the year for which such license is requested. Upon payment of such
fee, the City Clerk shall issue a license on a form provided for such
purpose.

The Police Department shall be charged with the duty of enforcing
the provisions of the ordinance.
