All swimming pools erected or constructed in
the City of North Tonawanda shall be enclosed by a fence, the height
of which shall be not less than 48 inches. All gates shall be self-closing
and self-latching.
All gates or doors permitting access to such
pools shall be equipped with a self-closing device and shall be equipped
with an automatic self-locking device.

Where pools are constructed aboveground, the
wall of such pool shall be considered as the fence required by this
chapter, provided that no point along the perimeter of the pool wall
is less than 48 inches in height. All ladders for entry and exit from
aboveground pools shall be capable of being secured, locked or removed
to prevent access.
Any person who shall fail to provide the fencing
or safety devices provided for in this ordinance shall be guilty of
an offense and, upon conviction thereof, be subject to a fine of not
less than $10 nor more than $100 for each such offense.
This ordinance shall take effect immediately.
