It shall be unlawful for any person, copartnership, corporation
or association to engage in or continue in the business of buying
or selling any old metal, paper, rags, scrap, iron, glass or salvage
material, which business is herein designated as junk business and
which person, association, copartnership or corporation is herein
designated as junk dealer, unless such junk dealer shall have complied
with the provisions of this ordinance and obtained a license so to
do from the Mayor of the City of North Tonawanda.
The power and authority to grant or refuse the license provided
for herein is hereby vested in the Mayor of the City of North Tonawanda,
and in considering the same he shall take into account the character
and nature of the neighborhood and surrounding property of the premises
upon which it is proposed to conduct such business; the health, safety
and general welfare of the public; and the character and reputation
of the applicant in connection with the maintenance and operation
of a business of this character. All licenses issued hereunder shall
expire on the 31st day of December following the date of their issuance,
unless sooner revoked for cause or by passage of an ordinance by the
City of North Tonawanda further restricting the junk business for
which such licenses shall have been issued.

All applications for said license shall be made to the City
Clerk of the City of North Tonawanda. The fee for said license shall
be $100 per calendar year or a fractional part of such year for which
a license hereunder shall be issued, which fee shall be payable to
the City of North Tonawanda.
No person, association, copartnership or corporation shall be
entitled to or receive such license who or which, in case of a corporation
or association any member of which, has been, since January 1, 1940,
or who or which shall hereafter be, convicted of larceny or knowingly
receiving stolen property or violation of this Act.
On purchasing any pig or pigs of metal, copper wire, brass car
journals, brass valves, oil cups or hose couplings, connections or
nozzles, such junk dealer shall cause to be subscribed by the person
from whom purchased a statement as to when, where and from which he
obtained the property, also his age, residence, by city, village or
town and the street and number (if any) and otherwise such description
as will reasonably locate the same, his occupation and the name of
his employer and place of employment or business, which statement
the junk dealer shall forthwith file in the office of the Chief of
Police of the City of North Tonawanda, New York.
Every junk dealer shall, on purchasing any of the property described
in the last section, place and keep each separate purchase in a separate
and distinct pile, bundle or package without removing from the City
of North Tonawanda or melting, cutting or destroying any article thereof
for a period of five days immediately succeeding such purchase, on
which package, bundle or pile shall be placed and kept by such dealer
a tag bearing the name and residence of the seller with the date,
hour and place of purchase and weight thereof.
No person who is the owner, keeper or proprietor of a junk shop,
junk cart or other vehicle, boat or vessel for the collection of junk
shall receive or purchase any goods, chattels, wares or merchandise
from any child under the age of 16 years.
Any violation of any of the sections of this ordinance shall
be deemed a misdemeanor and shall be punishable by a fine not exceeding
$50 for each offense.
This ordinance shall take effect immediately.
