The Department of Public Works and its subdivisions shall be supervised and administered by the Borough Engineer and the Superintendent of Public Works, and the Department of Public Works shall consist of the following divisions and such other divisions as may from time to time be determined by the Mayor and Council: Streets, Sewers, Parks, Borough Properties and Buildings, Maintenance and Operation and Engineering Services.
The Streets, Sewers, Parks, Borough Properties and Buildings and Maintenance and Operation Divisions shall be under the supervision of the Superintendent of Public Works, and all matters relating to the construction, operation and maintenance of streets, sidewalks, storm and sanitary sewers, curbs, snow removal, street cleaning, pumping stations, streetlighting, dumps, maintenance of street department equipment and supplies, buildings and real property and maintenance and operation thereof shall be assigned to appropriate divisions under the supervision of the Superintendent of Public Works as determined by the Mayor and Council from time to time or, when authorized, by the Superintendent of Public Works or by a designated councilmanic committee; and the Engineering Services Division shall be under the supervision of the Borough Engineer, and all personnel performing duties and functions relating to the matters set forth in this section shall be assigned to specific divisions and shall be under the supervision of either the Superintendent of Public Works or the Borough Engineer, as the case may be.
The office of Borough Engineer shall be a full-time office, and the person holding such office shall be a licensed engineer of the State of New Jersey and shall hold himself available for consultation and advice to all municipal officials, boards and commissions, upon request, and shall render such reports, recommendations, drawings or other documents as may be required at any time or upon special request and shall give his time exclusively to the Borough of South Plainfield and shall not accept any other employment directly or indirectly.

A. 
The office of Superintendent of Public Works shall be a full-time office, and the Superintendent of Public Works is hereby authorized and empowered to undertake and supervise all the tasks as shall be necessary to construct, operate and maintain, as the case may be, streets, sidewalks, storm and sanitary sewers, curbs, pumping stations, street lighting, Street Department equipment and supplies, buildings and real property, and to achieve snow removal and street cleaning, and he shall perform such other duties as may be assigned to him, and he shall hold himself available for consultation and advice to all municipal officials, boards and commissions upon request and shall render such reports and recommendations as may be required at any time or upon special request, and shall give his time exclusively to the Borough of South Plainfield and shall not accept any other employment directly or indirectly.
B. 
Any person who shall hold the position of Superintendent of Public Works for five consecutive years or more shall be granted tenure of office and shall continue to hold the position of Superintendent of Public Works during good behavior and efficiency, and shall be granted tenure pursuant to the provisions of N.J.S.A. 40A:9-154.6.
C. 
Any person who shall obtain tenure in the position shall not be removed from said position except upon a public, fair and impartial hearing in accordance with the provisions of N.J.S.A. 40A:9-154.6.
In case of the absence or disability of the Borough Engineer or the Superintendent of Public Works, or in the event that either of said offices should temporarily be unoccupied by reason of nonappointment or otherwise, then the Mayor and Council shall make such temporary appointments or assignments of duties, by resolution, as shall be, in its judgment, necessary, pending the making of regular appointments to said office or offices; the Mayor and Council shall also assign and transfer functions and duties from, to and between divisions as it may from time to time determine.
The Borough Engineer, Superintendent of Public Works and the Department of Public Works shall be under the supervision of such councilmanic committee or committees as the Mayor and Council may designate.
The Borough Engineer and the Superintendent of Public Works shall require periodic reports from the divisions under their supervision, and they shall make such reports to and at such times as they shall be required by the Mayor and Council or any committee thereof; further, both shall furnish to the Mayor and Council a bond in such amount and in such form and with such sureties as it shall determine.
The Mayor and Council may require the performance of such other duties from the Borough Engineer, Superintendent of Public Works and the personnel of subordinate divisions in the Department of Public Works as it shall from time to time determine.
