In any store, retail establishment or premises which offers cigarettes or tobacco products for sale to the public at large, the display of cigarettes or other tobacco products on counter areas within the reach of minors is hereby prohibited. All store owners or operators shall be required to place cigarettes or other tobacco products in a restricted area that can only be accessed by store employees and cannot be directly reached or accessed by any store patron.
Any store owner or manager violating the provisions of this chapter by allowing easy access to cigarettes or other tobacco products by the public at large shall be subject to a fine not exceeding $2,000, imprisonment for a term not exceeding 90 days or a period of community service not exceeding 90 days, or any combination thereof. Each day which said violation continues shall be considered a separate offense and shall be subject to a separate fine.
