Pursuant to Section 11 of the Uniform Fire Safety Act (P.L. 1983, c. 383),[1] the New Jersey Uniform Fire Code shall be locally enforced in the Municipality of South Plainfield.

The local enforcing agency shall be the Office of the Fire Marshal/Bureau of Fire Prevention.
The local enforcement agency shall enforce the Uniform Fire Safety Act and the codes and regulations adopted under it in all buildings, structures and premises within the established boundaries of South Plainfield, other than owner-occupied one- and two-family dwellings, and shall faithfully comply with the requirements of the Uniform Fire Safety Act and the Uniform Fire Code.

The local enforcing agency established by § 230-2 of this article shall carry out the periodic inspections of life hazard and local uses required by the Uniform Fire Code on behalf of the Commissioner of the Department of Community Affairs.

The local enforcement agency established by § 230-2 of this article shall be under the control of the Fire Official/Fire Marshal and shall report to the Mayor and Council.
A. 
Appointment of Fire Official/Fire Marshal. The local enforcing agency shall be under the supervision of the Fire Official as set forth in § 230-5 of this article, pursuant to Title 11A, Civil Service, the Revised Statutes (N.J.S.A. 11A:1-1 et seq.). The title "Fire Official" shall also include "Fire Marshal" and the person holding such position shall be known as the Fire Official or Fire Marshal or Fire Official/Fire Marshal. Only one person may be appointed and hold such titles.

B. 
Inspectors and employees. Such inspectors and employees as may be necessary for the local enforcing agency to properly carry out its responsibilities shall be appointed by the Mayor and Council of the Borough of South Plainfield, pursuant to Title 11A, Civil Service, of the Revised Statutes (N.J.S.A. 11A:1-1 et seq.), upon the recommendation of the Fire Official.[1]

C. 
Removal from office. Inspectors and other employees of the enforcing agency shall be subject to removal by the Fire Official for inefficiency or misconduct. Each inspector or employee to be so removed shall be afforded an opportunity to be heard by the appointing authority or a designated hearing officer named by the appointing authority. The Fire Official shall be subject to removal by the Mayor and Council for inefficiency or misconduct.
Pursuant to Section 15 and 17 of the Uniform Fire Safety Act (N.J.S.A. 52:27D-206 and 52:27D-208) any person aggrieved by any order of the local enforcement agency shall have the right to appeal to the construction Board of Appeals of the Borough of South Plainfield.

The Borough of South Plainfield may from time to time amend or change by ordinance any of the terms or provisions of this article upon the recommendation of the local enforcement agency. However, any such amendments must be more stringent than those established by this article and in accordance with the then existing applicable statutes and regulations adopted.
All ordinances or parts of ordinances inconsistent with this article are hereby repealed. However, the enactment of this article shall not be construed as abating any actions now pending under or by virtue of such article or as discontinuing, abating, modifying or altering any penalty accruing or to accrue or as affecting the liability of any person from or corporation or as waiving any right of the Borough of South Plainfield under any section or provision existing at the time of the passage of this article.[1]
