The words "vehicle," "park," "parking," "parking space" and "parked" as used herein shall have the meaning as defined in the Vehicle and Traffic Law of the State of New York. The word "person" shall mean and include any individual, firm, copartnership or corporation. The words "parking meter zones" as used herein shall mean such streets or parts of streets in the City of North Tonawanda where, pursuant to this ordinance, parking meters are installed, operated or maintained.
In the parts of the streets described in § 96-51 of this ordinance and established as parking meter zones, and in such other parking meter zones as may hereafter be created by ordinance of the City of North Tonawanda, parking meters shall be installed, operated, maintained, policed and supervised. Where parking meters are so installed, no vehicle shall be parked (except in an emergency or in compliance with the directions of a peace officer or traffic-control signal or sign) between the hours of 8:30 a.m. to 6:00 p.m., Sundays and holidays excepted, for a continuous period of more than the period of time as set forth in the established parking-meter zones described in § 96-51 of this ordinance, within a parking space alongside of or next to which a parking meter is located. Such parking meters shall be placed upon the curb or sidewalk alongside of or next to individual parking places, to be designated as hereinafter provided.
The parking meter maintenance man appointed by the Common Council shall supervise the operation and maintenance of such parking meters and shall see that said meters are kept in good condition: a record of the labor and repair cost shall be kept and a monthly statement thereof rendered to the Common Council. Upon audit, payment shall be made from the Parking Meter Fund. Said parking meter maintenance man shall periodically collect the coins deposited in said parking meters and pay the same to the City Treasurer.
The Chief of Police shall provide for policing and supervision of the parking meters.
Each parking meter shall be so set as to display a signal showing legal parking upon the deposit of from one to 10 one-cent coins or of one or two five-cent coins of the United States of America for the periods of time prescribed as parking time limits in § 96-36, § 96-40 and § 96-51 of this ordinance. Each meter shall by its device clearly set out and continue operation from the time of depositing such coin or coins until the expiration of the particular period of time. Each meter shall be so arranged that, upon the expiration of the particular parking limit, it will indicate that the period of time has expired.
When any vehicle shall be parked in any space alongside of or next to a parking meter which has been installed pursuant to this ordinance, the operator of such vehicle shall, upon entering the said parking space, immediately deposit either one or from one to 10 one-cent coins or one or two five-cent coins of the United States of America in the parking meter regulating such space, and set such meter in operation by the method described on each meter for the period of time herein prescribed for the coin or coins so deposited. Upon such deposit, the said parking space may be lawfully continuously occupied by such vehicle for 12 minutes upon the deposit of each one-cent coin up to a total of 10 one-cent coins for a total of two hours, or for one-hour upon the deposit of one five-cent coin or two hours upon the deposit of two five-cent coins of the United States.
It shall be unlawful and a violation of this ordinance for any person to cause or permit any vehicle registered in the name of or operated by such person to be parked in a parking meter space after expiration of the period of time established for parking space within the parking meter zones as stated in § 96-51 of this ordinance, or after the expiration of the period of time which such coin or coins shall have purchased or while the parking meter displays a signal indicating that the vehicle is being parked overtime.
Commercial trucks may park in the parking meter spaces to load or unload merchandise without depositing coins, for such period as may be required for such loading or unloading. Should any such truck be so parked for a period longer than that required for loading or unloading, it shall be deemed a violation of this ordinance by the operator of such truck.
The Chief of Police shall place lines or marks on the curb and on the street adjacent to or alongside of each parking meter to designate the space for which the meter is to be used, and the operator, when parking a vehicle alongside of or next to any parking meter, shall park it within the lines or markings so established and with the front bumper or foremost part of such vehicle alongside of or next to the parking meter. It shall be unlawful to park any vehicle across any such line or mark or to park a vehicle in such a way that it will not be entirely within the area so designated by such lines or markings.
No person shall deposit in any parking meter of the City of North Tonawanda any slug, device or substitute for a one-cent or a five-cent coin of the United States.
No person shall deface, injure, tamper with, open, break, destroy or impair the usefulness of any parking meter installed pursuant to this ordinance.
The Treasurer of the City of North Tonawanda shall keep a complete record of the collections made from all of said parking meters and shall deposit such collections in a special fund to be known as the Parking Meter Fund, and shall keep a separate account of all sums received as penalties, such sums to be deposited in the Parking Meter Fund of the city.
The one-cent coins and five-cent coins required to be deposited in said parking meters as provided herein are hereby levied and assessed as fees to provide for the proper regulation and control of traffic upon the public streets and also for the cost of providing for and regulating the parking of vehicles in the parking meter zones hereby created and to cover the cost of the installation, operation, purchase, control and use of such parking meters; and any surplus money over and above what may be needed for such purposes may be transferred to the general fund of the city.
Any person who shall violate the provisions of § 96-45 of this ordinance shall, on conviction, be liable to a fine of an amount equal to the cost of repairing or replacing the meter defaced, injured or destroyed and, in addition thereto, a sum not exceeding $100, or to imprisonment for a term not exceeding three months or to both such fine and imprisonment. Any person who shall violate any other provision of this ordinance[1] shall, on conviction, be liable to a fine not exceeding $5 for the first offense, and liable to a fine of not over $10 for a second offense and liable to a fine of not less than $10 or more than $25 for a third and any subsequent offense.

A. 
It shall be the duty of the police officers of the City of North Tonawanda to report:
(1) 
The number of each parking meter which indicates that the vehicle occupying the parking space adjacent to such meter is or has been parked in violation of any provision of this ordinance.
(2) 
The state license number of such vehicle.
(3) 
Any other facts relating to such violation.
B. 
The police officer observing such violation shall also attach to such vehicle a notice to the owner or operator thereof that such vehicle has been parked in violation of the provisions of this ordinance.1 Each such owner or operator may, on the first day thereafter which is not a Sunday or legal holiday, pay to the Chief of Police or his deputy, during his regular office hours, as a penalty for and in full satisfaction of such violation, the sum of $1. Failure of such owner or operator to make such payment within said period shall make such owner or operator subject to the penalties herein provided for the violation of the provisions of this ordinance.[1]

The provisions of this ordinance shall not apply to any parking in parking meter zones on Sundays or holidays, or between 6:00 p.m. and 8:30 a.m. of other days of the week.

Parking meter zones and the respective periods of time for parking within said zones are hereby established on the following streets and parts thereof in the City of North Tonawanda, to wit:
A. 
On Sweeney Street from Manhattan Street to Webster Street: one hour.
B. 
On the north side of Sweeney Street, from Webster Street to a point approximately 80 feet east therefrom: one hour.
C. 
On Webster Street, from Sweeney Street to Main Street: one hour.
D. 
On Main Street, from Sweeney Street to Island Street: two hours.
E. 
On Tremont Street, from Manhattan Street to Webster Street: one hour.
F. 
On the north side of Tremont Street, from Webster Street to Main Street: one hour.
G. 
On the south side of Goundry Street, from Manhattan Street to Webster Street: one hour.
