The R3 Use District is established to provide for development and use of lots in a portion of Indian Pines Subdivision (originally established in 1922) lying east of West Lake Road, a part of which is served by public sewers, and further to encourage the preservation of scenic and natural resources of both land and water and otherwise carry out the objectives of these regulations.
In this district no structure shall be erected or altered and no structure shall be altered or used except for one or more of the following specified uses:
A. 
Permitted principal use.
(1) 
Single-family dwellings, but not including mobile homes.
(2) 
Outdoor storage of boats and not more than one of each of the following: boat trailer, cargo trailer, unoccupied camp trailer, all owned for personal use by the resident of the premises.
B. 
Accessory use structures.
(1) 
Bathhouse, boathouse, beachhouse, detached private garage for use by passenger vehicles, boat slips, docks, playhouse, toolhouse, garden house, private swimming pool.
(2) 
No accessory use structure shall be operated for gain, shall be used for sleeping or living purposes or shall exceed one story or exceed 15 feet in height.
(3) 
In addition to the foregoing, one or more nonpermanent, movable structures, not exceeding 64 square feet in size, may be placed not closer than five feet from the side yard lot lines and road rights-of-way, including, but not limited to, a dog house, garden shed, lawnmower storage shed and beach gear storage shed.

C. 
Special use: none.
A. 
Area per dwelling unit and lot dimensions shall be as follows:
(1) 
The minimum width of the lot at the front building line and lakeshore shall be 50 feet. The minimum depth of the lot shall be 100 feet. Except as provided in Subsection A(1)(a) and (b), the minimum lot area shall be 5,000 square feet if all wastewater drains are connected to a public sewer or 20,000 square feet if such drains are not connected to a public sewer.
(a) 
Preexisting lot with sewer. No new structure may be erected nor any existing structure modified or enlarged on a preexisting lot having less than 5,000 square feet unless the total area of the new structure and any existing structures do not exceed 30% of the area of the lot, all setbacks are complied with and the structure is connected to a public sewer.
(b) 
Preexisting lot without sewer. No new structure may be erected nor any existing structure modified or enlarged on a preexisting lot having less than 20,000 square feet, which structure will not be connected to a public sewer, unless the total area of the new structure and any existing structures does not exceed 20% of the area of the lot and all setbacks and wastewater regulations are complied with.
(2) 
Front yards. There shall be a front yard of not less than 40 feet. For a lot between the public highway and the lake, this may be reduced to 15 feet to the high-water line. For purposes of this chapter, lakeshore lot line shall be measured at an elevation of 715.15 feet above sea level which has been established as mean high water level by the New York State Department of Environmental Conservation.
(3) 
Side yards. There shall be two side yards with a total width of not less than 20 feet, and the width of the narrower of the two side yards shall not be less than 10 feet.
(4) 
Rear yards. There shall be a rear yard of not less than 30 feet. For a lot between the public highway and the lakeshore, this may be reduced to 20 feet.
B. 
Height. No structure or building shall exceed 35 feet in height (except as provided in Article IV, § 160-15B).
C. 
Minimum area. The minimum building square footage for a one-story dwelling structure shall be 600 square feet, for a one-and-one-half-story residential building or structure, 1,000 square feet; for a two-story residential building or structure, 1,200 square feet. In calculating the minimum square footage as required herein, open porches, decks and steps shall not be taken into consideration.
D. 
Maximum lot coverage. No lot coverage shall exceed 30%.

E. 
Setbacks. Setbacks from the property line shall be measured from the closest point on any structure, which shall include porches, whether open or closed, decks and roof overhang.
