As used in this chapter, except where the context
clearly indicates otherwise, the following words or phrases have the
meanings indicated below:
ACCESS, EASEMENT OF
The right which an abutting owner has of ingress and egress
from his premises, in addition to the public easement in the street.
APPLICANT
A landowner, or developer, as hereinafter defined, who has
filed an application for land development or subdivision, including
his heirs, successors and assigns.
APPLICATION FOR DEVELOPMENT
Every application, whether preliminary or final, required
to be filed and approved prior to the start of construction, land
development or subdivision and which is complete in all respects as
required by this chapter.
BOROUGH
The Borough of Bradford Woods, Allegheny County, Pennsylvania.
BOROUGH ENGINEER
A professional engineer, individual or firm, licensed as
such in the Commonwealth of Pennsylvania, duly appointed as the Engineer
for the Borough.
BUFFER YARD
A portion of a site, together with any structure or plantings,
intended to provide a visual barrier or other protection between adjacent
parcels of land.
BUILDABLE AREA
That portion of a recorded lot bounded by the required front,
side, and rear yards.
BUILDING
Any enclosed or open structure having a roof supported by
columns, piers, or walls.
A.
BUILDING, ACCESSORYA detached, subordinate building, the use of which is customarily incidental and subordinate to that of the principal building and located on the same lot as the principal building.
B.
BUILDING, PRINCIPALA building in which the primary use of the lot on which the building is located is carried on.
CLEAR SIGHT TRIANGLE
An area of unobstructed vision at street intersections defined
by lines of sight between points at a given distance from the intersection
of street lines.
COMPREHENSIVE PLAN
The Bradford Woods Comprehensive Plan is a guide to community
development prepared by the Planning Commission and adopted by the
Council.
COUNCIL
The governing body of the Borough of Bradford Woods, Allegheny
County, Pennsylvania.
COUNTY
Allegheny County, Pennsylvania.
DEVELOPER
Any landowner, agent of such landowner or tenant with the
permission of such landowner who makes or causes to be made a subdivision
of land or a land development.
DEVELOPMENT
Any man-made change to improved or unimproved real estate,
including, but not limited to, buildings or other structures, streets,
and other paving, utilities, filling, grading, excavation, mining,
dredging or drilling operations and the subdivision of land.
DEVELOPMENT PLAN
The provisions for development including a planned residential
development, a plat of subdivision or land development, all covenants
relating to use, location and bulk of buildings and other structures,
intensity of use or density of development, streets, ways and parking
facilities, common open space and public facilities. The phrase "provisions
of the development plan" when used in this chapter shall mean the
written and graphic materials referred to in this definition.
A.
PRELIMINARY PLANThe plan of a proposed subdivision or land development, including all supplementary information required by this chapter or applicable Borough ordinance to obtain preliminary approval.
B.
FINAL PLANThe plan of a proposed subdivision or land development, including all supplemental information required by this chapter or by an applicable Borough ordinance to obtain final approval, and in a form acceptable for recording in the office of the Recorder of Deeds of Allegheny County.
DWELLING UNIT
One or more living or sleeping rooms with cooking and sanitary
facilities for one person or one family.
EASEMENT
A right of use over the property of another.
EXCAVATION
Any activity which results in the movement or disturbance
of more than 10 cubic yards.
FLOODPLAIN
The lands adjoining a river or stream that have been or may
be expected to be inundated by floodwaters in a one-hundred-year-frequency
flood.
IMPROVEMENTS
Physical changes to land, including, but not limited to,
grading, removal of vegetation, buildings, landscaping, pavement,
curbs, gutters, storm sewers and drains, and changes to existing watercourses,
sidewalks, street signs, monuments, water supply facilities, and sewage
disposal facilities.
LAND DEVELOPMENT
Any of the following activities:
A.
The improvement of one lot or two or more contiguous
lots, tracts or parcels of land for any purpose involving:
(1)
A group of two or more residential or nonresidential
buildings, whether proposed initially or cumulatively, or a single
nonresidential building on a lot or lots regardless of the number
of occupants or tenure; or
(2)
The division or allocation of land or space,
whether initially or cumulatively, between or among two or more existing
or prospective occupants by means of, or for the purpose of, streets,
common areas, leaseholds, condominiums, building groups or other features.
B.
A subdivision of land. (See "subdivision.")
C.
Land development shall not include:
(1)
The conversion of an existing single-family
detached dwelling or single-family semidetached dwelling into not
more than three residential units, unless such units are intended
to be a condominium.
(2)
The addition of an accessory building, including
farm buildings, on a lot or lots subordinate to an existing principal
building.
LAND DEVELOPMENT, MINOR
Any of the following:
A.
An addition to an existing building, where such
addition will occupy less than 5,000 square feet of land area.
B.
An expansion of an existing parking lot that
will add 25 or fewer parking spaces.
LANDOWNER
The legal or beneficial owner or owners of land, including
the holder of an option or contract to purchase (whether or not such
option or contract is subject to any condition), a lessee if he is
authorized under the lease to exercise the rights of the landowner,
or other person having a proprietary interest in land.
LOT
A designated parcel, tract or area of land established by
a plat or otherwise as permitted by law, recorded in the office of
the Recorder of Deeds of the county, and to be used, developed or
built upon as a unit.
LOT, CORNER
A lot situated at the intersection of two or more streets.
Front yard requirements apply to all yards abutting a street.
LOT, NONCONFORMING
A lot of record at the time of adoption of the Zoning Ordinance
which by reason of area or dimensions, does not conform to the requirements
of the Zoning Ordinance.
PLANNING COMMISSION
The Planning Commission of the Borough of Bradford Woods,
Allegheny County, Pennsylvania.
PLAT
The map or plan of a subdivision or land development, whether
preliminary or final.
PUBLIC HEARING
A formal meeting held pursuant to public notice by the Council
or the Planning Commission, intended to inform and obtain public comment
prior to taking action in accordance with this chapter.
PUBLIC NOTICE
Notice published once each week for two successive weeks
in the general circulation newspaper designated by the Council from
time to time as the official medium for advertising Borough business.
Such notice shall state the time and place of the hearing and the
particular nature of the matter to be considered at the hearing. The
first publication shall not be more than 30 days and the second publication
shall not be fewer than seven days from the date of the hearing.
SITE
Parcel of land for which land development approval is sought
pursuant to this chapter.
STREAM
Any river, run, creek or other drainage course draining surface
water in which standing or flowing water is clearly visible throughout
most of the year.
STREET
A right-of-way intended primarily for vehicular traffic and
usually providing for utilities and pedestrian travel, whether public
or private. A street may be designated by other appropriate names,
such as road, avenue, drive, lane or place. A street may also be identified
according to type of use as follows:
A.
LOCAL STREETStreets serving primarily as access to abutting properties and not intended as major arteries through traffic.
C.
CUL-DE-SACA short street having one end open to traffic and being permanently terminated with a turnaround.
D.
ALLEYPermanently reserved public or private means of access, generally provided as a secondary means of access to abutting property.
E.
PAPER ROADA road, street, way, lane or drive in the Borough of Bradford Woods which has never been opened to vehicular or pedestrian traffic nor dedicated to and/or accepted for public use by the Borough of Bradford Woods.
STRUCTURE
Any man-made object having an ascertainable stationary location
on or in land, whether or not affixed to the land.
SUBDIVISION
The division or redivision of a lot, tract or parcel of land
by any means into two or more lots, tracts, parcels or other divisions
of land, including changes in existing lot lines for the purpose,
whether immediate or future, of lease, partition by the court for
distribution to heirs or devisees, transfer of ownership or building
or lot development; provided, however, that the subdivision of land
for agricultural purposes into parcels of more than 10 acres, not
involving any new street, shall be exempted.
SUBDIVISION, MINOR
A subdivision of land into not more than four lots, not requiring
any new street or access easement.
WYE
(Noun) A support or other structure shaped like a Y, in particular
(in plumbing), a short pipe with a branch joining it at an acute angle.
