The purpose of this article is to enable the Borough of Eddystone to function under generally accepted principles of the Borough Council-Borough Manager form of government. The Borough Council shall be responsible for the legislative policy-making and for the appointment of a professional Borough Manager, who shall be responsible for supervising and conducting the administrative affairs of the Borough in a nonpartisan manner. It is the intent of this article to delegate to the Borough Manager all of the nonlegislative and nonjudicial powers and duties of the Borough Council as authorized by Section 1141 of the Borough Code (53 P.S. § 46141).
The position of Borough Manager for the Borough of Eddystone is hereby created. The Borough Manager shall be appointed for an indefinite term by the majority of all members of the Borough Council, who shall also fix the compensation for the position of Borough Manager from time to time as the Borough Council sees fit.
The Borough Manager shall be chosen solely on the basis of his or her executive and administrative qualifications, with special consideration given to his or her training, education and/or experience in municipal management. The person who fills the position of Borough Manager need not be a resident of the Borough of Eddystone at the time of his or her appointment, nor shall the person who fills the position of Borough Manager need to be a resident of the Borough of Eddystone during his or her tenure in appointed office of Borough Manager for the Borough of Eddystone.
Before commencing his or her duties, the Borough Manager shall give a bond to the Borough of Eddystone with a bonding company as surety, to be approved by the Borough Council, in such sum as the Borough Council shall from time to time determine, conditioned for the faithful performance of the Borough Manager's duties, with the premium for said bond to be paid by the Borough of Eddystone.
The Borough Manager shall be the chief administrative officer of the Borough of Eddystone. He/she or she shall:
A. 
Be responsible to the Borough Council for the administration and enforcement of the policies and programs established by the Borough Council.
B. 
Direct and supervise the administration of the departments, offices and agencies of the Borough of Eddystone, except as otherwise provided by law or ordinance.
C. 
Recommend the appointment and, when he/she or she deems it necessary for the good of the Borough of Eddystone, recommend the suspension or removal of any or all Borough employees and appointed administrative officials on the basis of merit and civil service system principles, except as otherwise provided by law. All appointments, suspensions and removals shall be subject to the approval of the Mayor and/or the Borough Council.
D. 
Make such recommendations to the Borough Council concerning policy formulation as he/she or she deems appropriate.
E. 
Prepare and submit the annual budget to the Borough Council, together with such explanatory comments as he/she or she deems appropriate, and administer the approved budget.
F. 
Keep the Mayor, the Borough Council and the public informed as to the conduct of Borough affairs.
G. 
See that all laws, ordinances, resolutions and enactments are duly enforced.
H. 
Prepare an agenda and attend all meetings of the Borough Council, with the right to take part in discussion but not to vote.
I. 
Negotiate and sign contracts for the Borough, subject to the approval of the Borough Council and/or the Mayor.
J. 
Perform such other duties as are designated by the Borough Council and/or the Mayor.
The Borough Manager shall receive such compensation as the Borough Council shall fix from time to time as it sees fit.
A. 
The person who fills the position of Borough Manager for the Borough of Eddystone shall be subject to removal by the Borough Council at any time by a vote of the majority of all members of the Borough Council.
B. 
Whenever the Borough Manager declines to submit his or her resignation or otherwise leave office at the request of the Borough Council, he/she or she may be removed from office in accordance with the following procedures:
(1) 
The Borough Council shall adopt a preliminary resolution of removal by a majority of all of the members of the Borough Council. The resolution shall state the specific reasons for removal and may suspend the Borough Manager from duty. A copy of the resolution shall be delivered within seven working days to the Borough Manager. In any event, the Borough Manager shall be paid forthwith any unpaid balance of his or her salary for that pay period immediately following the adoption of the resolution by the Borough Council.
(2) 
Within seven working days after a copy of the resolution is delivered to the Manager, he/she or she may file with the Borough Council a written request for a hearing. The hearing shall be held at a special executive session of the Borough Council. This hearing shall be held not earlier than 20 days nor later than 30 days after the request is filed.
(3) 
The Borough Council may adopt a final resolution of removal, which may be effective immediately, by a majority vote of all members of the Borough Council at any time after 10 days from the time when the preliminary resolution was delivered to the Manager, if he/she or she has not requested a hearing, or at any time after the public hearing.
(4) 
Whenever the Borough Manager declines to submit his or her resignation following his or her conviction of any felony or misdemeanor, the Borough Council may remove the Borough Manager from office by a motion to remove adopted by a majority of the members of the Borough Council at any public meeting.
The Borough Council may designate a qualified Borough employee to act as Borough Manager and to exercise the duties of the Borough Manager during the Borough Manager's absence or disability. During such absence or disability, the Borough Council may remove such designee and appoint another person to act as Acting Manager to serve until the Borough Manager shall return, his or her disability shall have ended or until a new Borough Manager is appointed.
