It is recognized by the Council of the Borough of Eddystone that the safety of persons and property will be enhanced and secured by the adoption of generally recognized electrical standards for the installation, conducting, consumption and use of electrical current, wiring, equipment and apparatus to be used, installed or repaired within said Borough. It is therefor ordained that in order to safeguard the public and the property of the public at large against the hazards and perils incident to such electrical current, wiring, equipment and apparatus as hereinabove mentioned, this chapter adopting said Electrical Code as hereinafter provided shall be adopted.
The provisions of this chapter shall not apply to any public utility engaged in the manufacture, transmission, conducting, distribution or supply of electricity under the jurisdiction of the Pennsylvania Public Utility Commission; nor shall they apply to employees of such utility in the course of their employment with said utility or persons, firms or corporations under contract with such utility with respect to work performed upon any wiring, equipment, apparatus or other facility owned or controlled by the utility; nor shall they apply to the servicing of appliances by distributor servicing agencies at the direction of said utility. The provisions of this chapter shall apply to all other private enterprises not contained herein engaged in by said public utility.
As used in this chapter, the following terms shall have the meanings indicated:
ELECTRICAL WIRING, EQUIPMENT AND APPARATUS
All supplies of every kind and nature, including but not limited to apparatus, appliances, wiring and fixtures used as a part of any installation, for the conducting, use or consumption of electrical energy in any form or for any purpose, including light, heat and power, except electrical items designed to be screwed or plugged into sockets or receptacles rather than permanently connected to a wiring system.
Electrical wiring, equipment and apparatus as defined herein may be installed, altered or extended only under the supervision of a registered master electrician, in accordance with the provisions of this chapter.

The Eddystone Borough Council shall appoint by annual resolution a qualified Electrical Inspector, whose duties shall include the enforcement of the provisions of this chapter and all other responsibilities that the Eddystone Borough Council shall direct in accordance with the provisions of this chapter.
Any and all persons desiring to obtain a registered master electrician's license shall make written application therefor to the Council of the Borough of Eddystone and shall supply it with such information as to qualifications, education, knowledge and ability as the Council shall deem appropriate. Said information shall be provided on the forms and in the form that the Council shall specify, and said applicant's qualifications, etc., shall be reviewed by the Council with the assistance of the Electrical Examining Board.

The Council of the Borough of Eddystone, having approved the applicant's qualifications, shall issue a license for each calendar year (or the remaining portion thereof following the applicants approval) to each applicant who qualifies, upon a payment of a fee of $50 for an electrical license and a fee of $30 for an air-conditioning license.
A. 
Before any license shall be issued by the Council, a certificate of business liability insurance shall be provided to the Council of the Borough of Eddystone with minimum limits for property damage in the amount of $25,000 and for personal bodily injury in the amount of $50,000 for any one person in any one accident and $100,000 aggregate for personal bodily injury covering any one accident. Further, said applicant shall also furnish a certificate, provided by an insurance company, certifying that his, her or its employees are covered by workmen's compensation in accordance with the laws of the Commonwealth of Pennsylvania. Such insurance above-mentioned must be maintained and in effect at all times in order that a master electrician's license shall be valid, and should said insurance be canceled, lapse or in any other way be discontinued, whether with or without the knowledge of the Council, said license shall be deemed ineffective, inoperative and invalid for the purposes of this chapter from the date on which said insurance shall expire, lapse or be discontinued.
B. 
All licenses shall expire on December 31 of each calendar year.[1]

The Council of the Borough of Eddystone does hereby adopt as its code for the purposes set forth herein the 1990 National Electrical Code, as approved by the American Standards Associations, and all amendments and supplements thereto.
The Council of the Borough of Eddystone shall determine, prescribe and promulgate the detailed standards for electrical wiring, equipment and apparatus and for the supplements as recommended by the National Fire Protection Association and approved by said National Electrical Code and set forth therein.
The Secretary of the Council of the Borough of Eddystone shall have on file for public inspection during ordinary business hours a copy of the National Electrical Code hereinbefore mentioned and a copy of this chapter.

A. 
All electrical wiring, equipment or apparatus while being installed in any structure in the Borough shall be kept open for inspection thereof at all times and not concealed from view by the permanent placement of parts or in any other way unless and until the Electrical Inspector has been notified of the completion of such installation and shall have inspected and approved all work performed and equipment used, in accordance with this chapter.
B. 
The registered master electrician under whose supervision any work has been performed or any installation made shall notify the Electrical Inspector and shall make application for the inspection and approval thereof and pay to the Electrical Inspector the fee required for such inspection. Said Electrical Inspector shall thereupon promptly inspect said electrical wiring, equipment or apparatus and the manner of installation thereof, and if the same, in the opinion of the Electrical Inspector, shall be in conformity with the standards and the requirements of this chapter, the Electrical Inspector shall issue his certificate of approval. Following said approval, the Electrical Inspector shall issue his cut-in card, in triplicate, and shall thereupon give one copy thereof to the person, firm or corporation or other agency supplying the electrical energy to be used in connection with or to be introduced into such electrical wiring, equipment or apparatus as provided in this chapter. The other copy of said cut-in card shall be given to the Council of the Borough of Eddystone and the original cut-in card to said property owner involved.

The Electrical Inspector, in his discretion, may require that a national fire underwriters agency inspect and approve the installation of electrical wiring, equipment and apparatus and the manner of installation thereof. In the event that the Electrical Inspector requires that a national fire underwriters agency perform such an inspection, all costs and charges for the inspection by a national fire underwriters agency shall be borne by the electrical contractor or the person, firm or corporation for whom the electrical contractor is performing the work.

A. 
Fee schedule. The following electrical permit fees shall be paid to the Borough of Eddystone upon filing of an application and shall apply to electrical work performed in the Borough. The fee shall be based on the actual contract price of any such work or, if no contract price has been agreed upon, then the applicant's estimated cost; provided, however, that upon review of the Electrical Inspector, with the assistance of the Borough Engineer, if required, such contract price or estimated cost is unrealistic, then the Electrical Inspector shall make the estimate of the cost which shall be final.

(1) 
Residential. New construction, alterations, additions and repairs: $20 per $1,000 of cost or fraction thereof.
(2) 
All new construction, other than residential: $30 per $1,000 of cost or fraction thereof for the first $50,000, then $15 per $1,000 of cost or fraction thereof for cost above $50,000.
(3) 
All alterations, additions and repairs other than residential: $30 per $1,000 of cost or fraction thereof for the first $20,000, then $15 per $1,000 of cost or fraction thereof for cost above $20,000.
(4) 
Work started prior to obtaining permit. Where work for which a permit is required by this chapter is started prior to obtaining the required permit, the fees set forth herein for such permit shall not relieve any persons from fully complying with the requirements of this chapter in the execution of the work or from any other penalties prescribed herein.
B. 
On all commercial and industrial work where periodic inspections are required, the Electrical Inspector shall determine whether or not an additional inspection is necessary, and, having done so, it shall be the obligation of the permittee to pay to the Electrical Inspector the sum of $7.50 per inspection, which sum shall be the Electrical Inspector's compensation for such additional inspection. In the event that the permittee shall refuse to pay such additional inspection fee, the Electrical Inspector shall have the option to cancel the permit and halt all work under the authority of the same until the additional fee is paid.[1]

A. 
In addition to any remedies or penalties hereinafter provided and not exclusive thereof, the Council of the Borough may order a stoppage of all work by the registered master electrician or his employees, agents or contractors when, in the opinion of the Council of the Borough, the provisions of this chapter and the aims of this chapter are being violated and when such stoppage, in the discretion of the Council of the Borough, is deemed necessary for the public health, safety and welfare.
B. 
The Council of the Borough may order all further unfinished and unstarted work, as provided hereinbefore, in or about any such buildings upon which work is being done to be stopped and may require all agents, employees and contractors of the registered master electrician in and about said building forthwith to vacate the property or the building or buildings in question.[1]

A. 
Any person who shall be convicted of a violation of any of the provisions of this chapter or of the code adopted hereby before any District Justice shall be sentenced to pay a fine of not more than $1,000 and costs of prosecution and, in default thereof, to imprisonment in the county jail for a term not to exceed 30 days.
B. 
All fines imposed by this chapter shall be recoverable in proceedings before any District Justice.
