From and after the passage of this article, any person and/or persons being the owner and/or owners of premises in the Borough of Eddystone may construct or cause to be constructed within that portion of any street in the Borough of Eddystone reserved for sidewalks a step and/or steps which may be necessary and/or convenient as a part of a building and/or buildings constructed or in the course of construction, subject to the following provisions:
A. 
Said step and/or steps shall not encroach upon any sidewalk or that portion of any street reserved for sidewalks for a distance of more than 24 inches from that portion of the sidewalk line adjoining the property line.
B. 
Said step and/or steps shall be so built as to form a part of the building and/or buildings already constructed or in the course of construction.
C. 
Any person and/or persons constructing a step and/or steps as provided for in this article shall do so with the understanding that the right or permit for the erection of such step and/or steps shall not be permanent but shall be subject to the right of Council to order said step and/or steps removed, as hereinafter set forth.
D. 
Council may at any time order the removal of said step and/or steps by giving 30 days' notice, in writing, to the owner and/or owners of said premises, either by serving notice on said owner and/or owners personally, by sending the owner and/or owners said notice by registered letter or by leaving a copy of said notice upon the premises.
E. 
Any request for the construction of a step and/or steps which are to encroach on any sidewalk in said Borough of Eddystone shall be presented, in writing, to the Highway Committee of Council for its approval, and before permission is granted to construct the same, the owner and/or owners shall agree, in writing, to all the provisions of this article.

Any person who shall be convicted of a violation of any of the provisions of this article before any District Justice shall be sentenced to pay a fine of not more than $1,000 and costs of prosecution and, in default thereof, to imprisonment in the county jail for a term not to exceed 30 days, for each and every day the offender and/or offenders shall permit such violation to continue and remain after due service of notice thereof to remove the same and, upon failure of the offender and/or offenders to remove the same within 30 days, the Borough shall cause the same to be removed and assess or charge the cost thereof to the offender and/or offenders.
