The Village Board of the Village of Middleport hereby finds and determines
that the unsupervised comings and goings and gatherings of minors under the
age of 18 years during nocturnal hours in the village has resulted in undesirable
activities, noise, acts of vandalism, loitering, trespassing, the commission
of offenses, use of alcohol and drugs, endangerment of such minors themselves
and the uneasiness of residents of the Village of Middleport and that the
health, safety and general welfare of the Village of Middleport and its residents
requires the imposition of a curfew upon such minors.
It shall be unlawful for any minor under the age of 18 to loiter, idle,
wander, stroll, play or remain in or upon a public place, including but not
limited to public streets, parks, playgrounds, buildings, vacant lots and
other public places, between the hours of 10:00 p.m. and 6:00 a.m. of the
following day in the Village of Middleport. The provisions of this section
shall not apply to a minor accompanied by his or her parent, guardian or other
adult having the legal custody of such minor or when such minor is on an emergency
errand or legitimate business directed by his or her parent, guardian or other
adult having the legal custody of such minor. The provisions of this section
shall not apply to minors going directly to or from any adult-supervised activities
sponsored by any school, church, civic or not-for-profit organization or any
minor going directly to or from his or her place of employment or to any minor
engaged in any activity guaranteed by the constitutions of the State of New
York or the United States of America.
It be unlawful for the parent, guardian or other adult having the custody
of a minor under the age of 16 years to permit, cause, allow or fail to prevent
such minor to be in any public place in violation of this chapter.
