Except as provided in § 150-39, no industrial user shall discharge or cause to be discharged any wastes either directly or indirectly into the Village treatment works without first obtaining a sewer use permit issued by the Village.
New industrial users which desire to locate into the Village sewer service area or existing industrial users which desire to commence operations at a new facility within the Village shall apply for and receive a sewer use permit prior to the commencement of operations at the new facility. For the purposes of this section, any industrial user who has ceased discharging industrial wastes for a period of 30 days or more shall be considered to be a new industrial user except for permitted seasonal dischargers. A change in ownership or lease arrangement of the facility shall cause an industry to be a new industrial user for purposes of this section. All new categorical industrial users are required to submit baseline monitoring reports and comply with § 150-30B.
All industrial users discharging industrial wastes directly or indirectly to the Village treatment works prior to the effective date of this Part 1 are hereby granted temporary authority to discharge these wastes. This temporary authority shall expire 90 days after the effective date of this Part 1. Any person discharging pursuant to the temporary authority provided for hereby is subject to all provisions of this Part 1 and such authority may be suspended or revoked in accordance with the various terms and provisions set forth in this Part 1. Prior to the expiration of 90 days each existing industrial user shall apply for a sewer use permit in accordance with § 150-37 et seq. Any industrial user which complied with this section as set forth in the predecessor to this Part 1 shall be deemed to have complied with this section.
If a permittee wishes to continue discharging to the Village treatments works, he shall request a renewal of his sewer permit no less than three months prior to the expiration date of the permit then in force. Failure to make a timely application will result in the expiration of the permit. The request shall be contained in a form prepared by the Village. Renewal of the permit shall be contingent upon the permittee having complied with the terms and conditions of the existing permit. Sewer use permit application forms shall be available at the office of the Village Clerk.
Permits will expire as indicated in the permit, but no longer than five years. Renewal of the permit will be dependent upon compliance with the terms and conditions included in § 150-40.
Any industrial user that proposes to make any changes in its facility or processing which significantly affects either the quality or quantity of its discharge to the Village treatment works shall apply for an amended permit on forms provided by the Village. The amended permit must be obtained prior to such change.
Sewer use permits are issued to a specific industrial user for a specific operation and are not transferable. A permit shall not be reassigned or transferred or sold to a new owner, new industrial user or a new or changed operation. The permittee shall notify the Superintendent within 14 days of any change in ownership or corporate structure, and shall proceed in accordance with § 150-38.
A. 
Persons desiring a permit to discharge shall complete a Village application form and forward it to the Village. Upon receipt of all required information, the application shall be processed and if required and upon approval a permit shall be issued. The application shall be processed and a permit issued or denied with reasons stated for denial within 45 days by the Village.
B. 
The application shall be approved if the applicant has complied with all applicable requirements of this Part 1, has furnished to the Village all requested information and the Village determines as follows: that there is adequate capacity in the Village POTW to convey, treat and dispose of the industrial wastes; that there is adequate capability within the POTW to treat the wastes without disruption of the treatment process; and that the proposed discharge is allowed by this Part 1. Prior to acting on a permit application, the Village may require any additional information, studies or testing deemed necessary to make a determination.
C. 
An application submitted by a corporation shall be signed by a corporate officer and shall include a corporate resolution granting the individual the authority to make the application on behalf of the corporation. An application submitted by an industrial user other than a corporation shall be signed by the owner or general partner. An application submitted by a corporation shall list the 10 largest shareholders and the percentage of stock owned by each, and the name of each director.

All sewer use permit applications and user reports must contain the following certification statement: "I certify under penalty of law that this document and all attachments were prepared under my direction or supervision in accordance with a system designed to assure that qualified personnel properly gather and evaluate the information submitted. Based on my inquiry of the person or persons who manage the system, or those persons directly responsible for gathering the information, the information submitted is, to the best of my knowledge and belief, true, accurate and, complete. I am aware that there are significant penalties for submitting false information, including the possibility of fine and imprisonment for knowing violations."
D. 
Where confidentiality is claimed by an industrial user, the Village shall conform to 40 CFR 403.14. Information and data provided to the Village which is effluent data shall be available to the public without restriction.
A. 
Sewer use permits may be conditioned on any of the following conditions:
(1) 
Monitoring requirements for user charge.
(2) 
Monitoring requirements for pretreatment.
(3) 
Prohibitions and limitations on industrial wastes discharged to the sanitary sewer.
(4) 
Compliance schedules.
(5) 
Reporting requirements.
(6) 
Management requirements and responsibilities.
(7) 
Special conditions applicable to industrial users on a case-by-case basis.
B. 
The terms and conditions of the permit may be subject to modifications and change by the Village during the life of the permit. The industrial user shall be informed of any changes in his permit at least 10 days prior to the effective date of change. Any changes or new conditions in the permit shall include a time schedule for compliance.
