The following rates are hereby established for water rentals
in the Village of Middleport. The minimum charge will be charged for
all metered connections whether or not there is any usage.
A. The minimum charge shall be $39.28 charged per three-month period
and shall cover the cost of providing the first 5,000 gallons of water
consumed.
B. The next 70,000 gallons per three-month period shall be charged at
$5.99 per thousand gallons of water consumed.
C. All water consumed over 75,000 gallons per three-month period shall
be charged at the rate of $4.27 per thousand gallons consumed.
D. Meter rentals shall be $3.50 per three-month period.
E. The Board of Trustees may hereafter amend the water rates from time
to time by resolution.

There shall be added to any water charge paid
after the 30th day from the billing date a penalty of 10% of the amount
of the bill, and there shall be added to any water charge paid after
the 60th day from the billing date an additional 10% of the amount
of the original bill.

A. Whenever a water bill shall remain unpaid after 60
days from the billing date, the water service may be terminated. Prior
to termination, the Village Clerk shall cause a notice of termination
to be served upon the owner of record on the current tax roll maintained
by the Assessor of the Town in which the property is located and,
in the case of multiple residences, upon the tenants of the premises.
For purposes of this section, "multiple residences" shall mean any
residential building containing two or more units.
B. Notice of termination.
(1)
Notice shall be given by regular mail to the
owner of the premises. Notice shall be given by regular mail to one
adult tenant of each unit of a multiple dwelling if the name of the
tenant is known to the Village Clerk. If the name is not known, it
shall be mailed to "Occupant." In addition, notice shall be either
personally served upon an adult tenant or, in the alternative, affixed
to the entryway of the tenant's unit, or, if the entryway is not accessible,
to the main entry to the multiple residence.

The notice shall state that water service will
be terminated on or after a specified date. The date shall be not
less than 30 days after the date of the notice and shall allow for
payment of the bill together with all penalties up to the date of
shutoff. Said notice shall further state that the owner or tenant
may request a hearing before the Village Board to contest the amount
of the bill or to challenge the propriety of the charges.
C. Any person or entity receiving water from the Village
shall be deemed to have contracted with the Village for water services
from the Village and shall be deemed to consent to entry on his or
her premises for purposes of reading meters or termination of services.
When entry is denied, the Village officers or employees shall be entitled
to a warrant to enter, and any expense incurred by the Village to
gain entry shall be an additional charge added to the water bill.
D. When an outstanding water bill is added to the taxes
assessed against the premises served, water service shall be restored
upon request of the person responsible for payment of the bill and
upon payment of the reconnection fee.

Whenever water service shall have been terminated
pursuant to this article or for any other reason, including request
of the owner of the premises, a fee in the amount of $100 shall be
paid prior to restoration of service, to cover the expenses incurred
by the Village to terminate and restore service.
Any water provided to consumers outside of the
Village of Middleport shall be charged at a rate which shall be double
to the rate charged to Village of Middleport residents.

These water rates shall be in effect for the
February 1, 2006, billing.
