An Environmental Advisory Council is hereby established by the Borough of Harveys Lake, Luzerne County, Commonwealth of Pennsylvania. Said Council will advise the local governmental agencies on matters dealing with protection, conservation, management, promotion and use of natural resources, including air, land and water resources located within the territorial limits of the Borough of Harveys Lake.
The Environmental Advisory Council shall be composed of seven residents, who will be appointed by the Borough of Harveys Lake. The term of the individual appointments shall be for three years, except that the initial appointments shall be so staggered that the terms of three members will be for one year, two members for two years and two members for three years.
The members shall receive no compensation for their services but shall be reimbursed for the expenses actually and necessarily incurred by them in the performance of their duties.
The Borough Council shall designate the Chairman of the Advisory Council.
The Environmental Advisory Council shall have power to identify environmental problems, to recommend plans and programs to the appropriate agencies for the promotion and conservation of the natural resources and for the protection and improvement of the quality of the environment within its territorial limits and to make recommendations in order to promote a community environmental program.

As used in this article, the following terms shall have the meanings indicated:
BOROUGH
The Borough of Harveys Lake, a municipal corporation existing under the laws of the Commonwealth of Pennsylvania.
ENVIRONMENTAL ADVISORY COUNCIL
A council created pursuant to an ordinance of the Borough of Harveys Lake dated July 24, 1985,[1] and with the express power to identify environmental problems, to recommend plans and programs to the appropriate agencies for the promotion and conservation of the natural resources and for the protection and improvement of the quality of the environment within its territorial limits and to make recommendations in order to promote community environmental programs.

A special fund is hereby established pursuant to the Act of May 1, 1966, P.L. 581 [53 P.S. § 46202(32), as amended], in which moneys are set aside for the use as prescribed herein by the Environmental Advisory Council of the Borough of Harveys Lake.
Any such moneys placed in this special fund shall be derived from or received from any source other than taxation. Such moneys may derive from, by explanation but not limitation, the following sources: private contributions, corporate contributions and nonprofit corporate contributions, except any such moneys which are received or acquired by the Borough from outside sources designated for particular purposes.
The special fund shall be controlled, invested and administered, including all income and principal therefrom, by the Environmental Advisory Council as required by federal, state and local laws and regulations. Such special fund, income and principal therefrom shall be expended for the normal and necessary expenses as relating to the environmental problems, plans, programs, promotion and conservation, protection and improvement of the quality of the body of water known as Harveys Lake and its watersheds.
