For the purposes of this chapter, the following terms shall have the following meanings:
ALCOHOLIC BEVERAGE
Any substance falling within the definition of "alcoholic beverage" and related definitions contained in § 3 of the Alcoholic Beverage Control Law of New York, as amended from time to time.
CONTAINER
Any can, bottle, cup, glass or other vessel capable of holding an alcoholic beverage.
INTENT TO CONSUME
Drinking from the container, with alcohol on the breath of the possessor and/or any circumstances evidencing an intent to ultimately consume on any public lands.[1]
PERSON
Any natural person, notwithstanding his or her age.
STREET
Any village street or private street, way or road affording access to the public or the property owners along the same, by foot or vehicle, including the entire width of the right-of-way of such street, way or road.

A. 
Consumption prohibited. It shall be unlawful for any person to consume any alcoholic beverage or to be in possession of any alcoholic beverage in an open container while said person is on any public street in the Village of Harriman.

B. 
Carrying open containers prohibited. It shall be unlawful for any person to carry on his person on a street a container of any kind that is open or unsealed in which there is any alcoholic beverage, with the intent to consume the same.

A violation of this chapter shall be punishable by a term of imprisonment of up to 15 days or a fine of up to $250, or both.
