In interpreting and applying the provisions of this chapter, they shall be held to be the minimum requirements for the purposes set forth in § 140-2. Except where expressly provided otherwise, it is not intended by this chapter to repeal, abrogate, annul or in any way impair or interfere with any rule, regulation, law or ordinance of the Village relating to the use of land or buildings; nor is it intended by this chapter to interfere with or abrogate or annul any easement, covenant or other agreement between parties; provided, however, that where this chapter imposes a greater restriction upon the use of land or buildings than is imposed or required by any other statute, law, ordinance, rules or regulation or by any easement, covenant or agreement, the provisions of this chapter shall control. In the event of conflict in the terminology of any section or part thereof of this chapter, the more restrictive provisions shall prevail.
The Village Code Enforcement Officer shall administer and enforce the provisions of this chapter except where otherwise herein specifically required; and whenever any permit is provided for herein, shall be applied for and shall issue in the first instance from office of the Village Code Enforcement Officer.
A. 
Any person who permits or commits any acts in violation of any of the provisions of this chapter shall be deemed to have committed an offense against such chapter and shall be liable for the penalty provided. Each day a violation shall continue or be permitted to exist after notice has been mailed to the property owner by the Code Enforcement Officer and posted on the building or property shall be construed as a separate violation.
B. 
Any violation of the provisions of this chapter shall be a violation. For a violation of any provision of this chapter, the person violating same shall be subject to the following penalties: for a first offense, a maximum fine of $250 or imprisonment of up to 15 days in jail, or both such fine and imprisonment; for a second offense committed within five years, a minimum fine of $250 and maximum fine of $500 or imprisonment of up to 15 days in jail, or both such fine and imprisonment; for a third offense committed within five years, a minimum fine of $500 and a maximum fine of $1,000 or imprisonment of up to 15 days in jail, or both such fine and imprisonment.

C. 
[1]In addition to the above-provided penalties and punishment, the Village Board may also maintain an action or proceeding in the name of the Village in a court of competent jurisdiction to compel compliance with or to restrain by injunction the violation of this chapter.
