Pursuant to the provisions of N.J.S.A. 40:48-1 and 12:7-34.53, the maintenance, operation or use of gasoline-powered motorboats on the body of water known as "Fairview Lake," situate in the Township, shall be and is hereby prohibited. Nothing herein contained shall be construed to prohibit the operation, maintenance and use of boats propelled by electric power.
The Boat Regulation Commission of the State of New Jersey shall adopt rules and regulations deemed necessary for the safety of persons using the waters of Fairview Lake pursuant to the provision of N.J.S.A. 12:7-34.53.
Any person violating any provision of chapter section shall, upon conviction, be subject to a fine not exceeding $100 and, in default of the payment thereof, shall be subject to imprisonment for a period not exceeding 10 days. Any person convicted of a second offense of the same violation shall be subject to a fine in double the amount prescribed for a first offense and shall, in default of the payment thereof, be subject to imprisonment for a period of not exceeding 20 days in accordance with the statute in such case made and provided.
