This article is enacted in recognition of the fact that the owners of private, residential, commercial and industrial property in the Town of Richmond have from time to time provided a place or places where solid waste, commonly referred to as "garbage or rubbish," can be deposited by said owners and their tenants, licensees and/or invitees in bulk refuse disposal containers provided by said owners, referred to generically as "dumpsters," that said bulk refuse disposal containers are located wholly within the boundaries of privately owned residential, commercial and industrial property within the Town of Richmond, and the cost of placement, transport and disposal is paid by said owners. It is the intent of this article to enable the Town Board of the Town of Richmond, as it sees fit, to provide regulations governing the restriction and use of those facilities by persons or other entities, not authorized or otherwise permitted by the owner of the property upon which it is located, to use the same for disposal of garbage or rubbish.
Each dumpster or other bulk disposal container placed upon private property wherein the owner of said property wishes to be provided the protection of this article, other than for temporary use for demolition or other purposes not to exceed 14 days, shall have prominently displayed on or near the bulk disposal container a sign advising all persons that placement of garbage or refuse in said bulk refuse container without the express permission of the owner of the property upon which it is located is a violation of this article. The Town Board of the Town of Richmond may designate, by resolution,[1] the size and wording of the sign to be placed on or near said dumpster or other bulk refuse disposal container and shall obtain the same. Said signs may be purchased at cost from the Town Clerk by the owner or owners of any property within the town where said dumpster or other bulk refuse disposal container is located.

Any person who violates this article shall be guilty of a violation, and upon conviction thereof, shall be subject to a fine of not less than $100, and not more than $500, or imprisonment for a term not to exceed 15 days, or both.
Any resolution of the Town Board authorized by this article may be adopted without public notice or public hearing.
