There is hereby imposed and established a sanitary sewer user fee/surcharge to be assessed against each user of the sanitary sewer system in the Borough of Ingram at the rate as set from time to time by resolution of the Borough Council.
A. 
The sanitary sewer user rate/surcharge provided for herein shall be billed quarterly, with all bills rendered as of the first day of the month following the quarter for which service was provided. Payment shall be due and payable within 30 days of the date of the billing statement.
B. 
If the owner or occupant of a premises served by a water utility neglects or fails to pay, for a period of 30 days from the due date, a rental, rate, or charge for sewer, sewage, sewage treatment services imposed by the Borough of Ingram, then the Borough of Ingram may request, in its direction, that any company providing services to the Borough of Ingram for delinquent sewage collection, institute the shutoff of the supply of water to the premises until all overdue rentals, rate, charges, penalty and interest are paid.

In the event the charges for sanitary sewer system service remain unpaid for a period of 30 days from the date of said statement, such charges are hereby declared to be delinquent, and a penalty of 1.5% of the amount of the statement shall be added.
For each delinquent sanitary sewage account remaining unpaid 90 days after the date of the statement, a service charge of 3% shall be assessed, based upon the gross delinquent charge or outstanding portion thereof.
In addition to the penalty and service charges set forth in §§ 146-14 and 146-15 above, in the event that the Solicitor for the Borough of Ingram initiates legal proceedings to collect the amount due under this article, then the Solicitor shall be entitled to assert a claim for and receive payment of attorney's fees from the user of the sanitary sewer system in accordance with the procedure set forth in Act No. 1 of 1996[1] and Chapter 71, Article I, Attorney's Fees, as may be amended.

A. 
The sanitary sewer user fees/surcharges collected under and pursuant to this article shall be deposited by the Borough of Ingram in a special fund, designated as the "Sanitary Sewer Fund," to be used for the purpose of repairing, replacing, cleaning and maintaining the existing sanitary sewer system within the Borough of Ingram, including therein all such engineering, condemnation and/or legal fees that may be incurred in connection with the sanitary sewer system.
B. 
The sanitary sewer user fee/surcharge, as imposed by such this article, and the fund created thereby shall be utilized for the construction, repair, replacement or maintenance of the Borough's storm sewer system in addition to the uses identified in Subsection A relative to the Borough's sanitary sewer system.
