A Recreation Board to be known as the "Prospect Park Recreation Board" is hereby created and established to oversee, maintain and promote recreational activities within the Borough of Prospect Park, subject to the approval of the Borough Council of the Borough of Prospect Park and subject to the applicable laws of the Commonwealth of Pennsylvania.
A. 
The Prospect Park Recreation Board shall consist of five members, who shall be appointed by the Borough Council of the Borough of Prospect Park to serve for a term of two years or until their successors are appointed, except for the terms of the members of said Board first appointed as set forth hereinafter. With regard to the members of said Board first appointed, two members shall be appointed for a term of one year, three members shall be appointed for a term of two years; and at the expiration of the terms of each of the members of said Board first appointed, a successor shall be appointed by the Borough Council of the Borough of Prospect Park to serve for a term of two years. Vacancies in said Board occurring otherwise than by expiration of term shall be filled for the unexpired term in the same manner as original appointees. Members of said Board shall serve without pay.
B. 
The Prospect Park Borough Council shall designate one of its members to be an ex officio member of the Recreation Board, which member may participate in all Recreation Board meetings and shall be entitled to participate in all Recreation Board matters except for the election of Recreation Board officers.
C. 
The Offices of Borough Council and Recreation Board shall not be incompatible.
A. 
The members of the Prospect Park Recreation Board shall elect their own Chairman and Secretary and select all other necessary officers, to serve for a period of one year, which term shall begin on January 1 and end on December 31 of each and every year.
B. 
Said Board shall organize during the month of January of each and every year and shall hold regular meetings at such time and places as it may designate.
The Prospect Park Recreation Board shall have the power to:

Recommend rules and regulations for the conduct of all business within its jurisdiction and subject to the laws of the Commonwealth of Pennsylvania. Any rules and regulations recommended by the Recreation Board shall be submitted to the Borough Council for approval and shall not be incompatible with any ordinance or regulation adopted by the Prospect Park Borough Council.
B. 
Identify the open space, recreation, park and trail needs of the Borough.
C. 
Plan and supervise recreation programs approved by the Borough Council.
D. 
Recommend plans, programs and policies regarding the provision of recreation and park services.
E. 
Undertake recreation and park tasks as requested by the Borough Council.
The Borough of Prospect Park may accept any grant, gift, bequest or donation of services, equipment, real estate and/or money from any individual or group, to be used as specified by the donor or by the terms of acceptance subject to the approval of the Borough Council of the Borough of Prospect Park. The Recreation Board may solicit such contributions to be made to the Borough. Disbursement of any moneys so received shall only be done with the approval of the Borough Council of the Borough of Prospect Park.
The Prospect Park Recreation Board shall have no authority to enter into any contract and/or to incur any obligation which would be binding upon the Borough of Prospect Park without the approval of the Borough Council of the Borough of Prospect Park.
The Recreation Board shall keep minutes of its meetings and shall provide same to the Borough Council after approval. Upon request of the Borough Council of the Borough of Prospect Park, the Prospect Park Recreation Board shall make full and complete reports, financial and otherwise, to said Borough Council.
