The following rules and regulations are hereby established for
the management and protection of all parks now owned or hereafter
acquired by the Borough, hereinafter designated as "the parks."
A. The parks shall be open daily to the public between the hours of
8:00 a.m. and 6:00 p.m., Eastern standard time, and 8:00 a.m. and
9:00 p.m., daylight saving time. At 6:00 p.m., Eastern standard time,
and 9:00 p.m., daylight saving time, all activities in the parks shall
cease and all persons in the parks shall leave as soon as possible
thereafter. No person, other than authorized employees thereof, shall
be in the parks at any time between 6:00 p.m. and 8:00 a.m., Eastern
standard time, and 9:00 p.m. and 8:00 a.m., daylight saving time,
on the following morning unless authorized by the Recreation Board.
B. No person shall injure, deface, remove, cut or damage any of the
trees, plants, shrubs, turf, buildings, structures or fixtures therein,
or any other property of the Borough located within the parks.
C. No person shall remove any bench, seat or table from the parks or
change the location thereof without permission from the Recreation
Board of the parks.
D. No person shall conduct himself within the parks so as to annoy any
other person using the parks for recreational purposes or act disorderly
in any manner while in the parks.
E. No person shall hold any meeting or gathering, assembled through
advertisement or public notice, or any gathering otherwise assembled
and composed of 25 or more persons, including organized sporting events
or games, within the limits of the parks without having first made
application to the Borough Secretary for a permit therefor. Such permit
shall indicate the spot in the parks where such gathering or meeting
shall be held, and such gathering shall not be held at any other spot
within the parks. The application for such permit shall be in the
name of a person who shall be responsible for seeing that all refuse
left by the group shall be placed in proper containers before leaving
the parks. Any violation of the rules and regulations governing the
parks as set forth in this chapter by any member of the permitted
group may be cause for revocation of the permit by the Recreation
Board and/or Borough Council. The Mayor and/or the Prospect Park Police
Department shall have the authority to suspend any permit upon the
observation of the violation of any of the rules and regulations governing
parks in this chapter or if the suspension of such permit is necessary
to protect the health, safety and/or welfare of the residents of Prospect
Park or to protect public property.
F. No person shall set up any booth, table or stand for the sale of
any article whatsoever within the limits of the parks without the
consent of the Borough, which shall have authority to refuse such
consent in any instance.
G. No person shall dispose of any waste or garbage in the parks except
in receptacles designated for the respective purposes. All persons
using the parks shall dispose of all waste and garbage left by them
in such proper receptacles.
H. No person shall injure, deface or destroy any notice, rule or regulation
posted at any place within the parks by authority of the Borough Secretary
or any other authority of the Borough; nor shall any person post,
at any place within the parks, any notice or placard other than by
authority of the Recreation Board.
I. No person shall bring any alcoholic beverage into the parks, either
for his own use or for the use of any other person.
J. No person shall set or maintain any fire in the parks except in stoves
and fireplaces maintained for the purpose and located by authority
of the Recreation Board.
K. No person shall discharge any firearm or any other type of weapon
or device capable of firing a projectile within the limits of the
parks.
L. No person shall use any tobacco product or smoke any product within
the limits of any park.
M. No person shall play or attempt to play golf of any type or form
within the limits of the parks. "Golf" is meant to include the hitting,
driving or putting of a golf ball.
N. No person shall operate any motor vehicle and/or motorbike of any
kind within the limits of the parks unless authorized by the Recreation
Board. This subsection shall not apply to duly authorized employees
and/or officials of the Borough of Prospect Park.
O. No person over 12 years of age shall play upon, sit upon, stand upon
and/or use in any manner any normal tot-lot playground equipment and/or
normal tot-lot apparatus situated within the parks.
P. Basketball playing in parks limited. The use of basketball courts in the parks by the public shall be between the hours of 9:00 a.m. and 9:00 p.m. daily. Any organized basketball games or competitions that include the participation of 12 or more individuals must first obtain a permit as provided in Subsection
E, above. Such games or competitions shall be considered organized if planned prior to the event in any manner.
Q. No person shall skateboard or roller-skate within the limits of the
park.
Any person who shall violate any provisions of this chapter
shall, upon conviction thereof, be punishable by a fine of not more
than $300 and costs of such proceedings or, upon default of payment
of such fines and costs, by imprisonment in the county jail for a
term of not more than 30 days. The continuation of such violation
for each successive day shall constitute a separate offense, and the
person or persons allowing or permitting the continuation of the violation
may be punished as provided above for each separate offense.
