No person or persons shall at any time after the passage of this chapter put, place, deposit or throw any glass, crockery, china, cuttings of tin or iron, nails, ashes, garbage, wastepaper, rubbish or any form of refuse, waste matter or trash in or on any street, highway or alley in the Borough of East Petersburg except by permission of the Mayor or Borough Council.
Any person or persons or any officer or employee of any firm or corporation violating any of the provisions of this chapter shall, upon conviction thereof before any Magisterial District Judge of the Borough of East Petersburg, be sentenced to pay a fine of not more than $300 and, in default of payment thereof, shall be imprisoned in the Lancaster County Prison for not more than 30 days; provided, however, that if the Magisterial District Judge determines that the defendant is without the financial means to pay the fines and costs immediately or in a single remittance, such defendant shall be permitted to pay the fines or costs in installments and over such periods of time as the Magisterial District Judge deems to be just.
