No member of the council or any other officer
or employee of the town shall be financially interested, directly
or indirectly, either as principal, surety, officer, partner or otherwise,
except as minority stockholder, or except as director in a corporation,
in any contract with, sales to, purchase from or compensable service,
made with or rendered to the town. The provisions of this section
shall not apply to any contract awarded to the lowest responsible
bidder, after public advertisement.
No person except the secretary of a commission
or board shall hold at the same time more than one office or employment
for which compensation or allowances, other than for reasonable expenses,
are paid out of town funds, unless he or she shall waive the payment
of such compensation for one of such offices.
No person shall serve more than two consecutive
terms on any appointed board, commission or similar body, and at the
completion of two consecutive terms such person shall not be eligible
for reappointment to the same board, commission or similar body until
the next vacancy shall exist because of expiration of the term of
an incumbent; and no person who has served two consecutive terms on
any board, commission or similar body shall be eligible for appointment
to fill an unexpired term caused by resignation, death or removal
of an incumbent until the period specified above has elapsed. For
the purpose of this section, a person appointed to fill a vacancy
for the remainder of a term shall be deemed to have served a full
term when the remainder for which he or she was appointed shall be
more than one-half the normal term of appointment.
On all appointive boards, commissions and similar
bodies at least one member shall be a member of a party or political
organization represented on the council to which belong less than
a majority of the members of the (town) council. The council, by ordinance,
may require that minority representation greater than one member may
be required on any appointive board, commission or similar body.
No person shall be appointed to, or serve at
the same time on, more than one board, commission or similar body,
the appointment to which is fixed by charter or by ordinance.
Members of boards, commissions and similar bodies
and appointive employees outside the classified services of the town,
as defined in Section 2 of Chapter VIII of this charter, may be removed
from office by the appointing authority, unless specifically provided
otherwise by this charter. Removal by the appointing authority of
any such person, except a part-time, hourly-paid employee, shall be
commenced by the giving of a notice of proposed removal, stating therein
the effective date of such removal, which date shall be not less than
fourteen days after receipt of said notice by the person to be removed.
The person to be removed, except a part-time, hourly-paid employee,
upon his or her request, shall receive in writing a statement of the
reasons for such removal within five days of said request. If such
person, except a part-time, hourly-paid employee, shall desire a hearing
thereon he or she shall request the same in writing within ten days
of the receipt of said notice, and the appointing authority shall
set a hearing date not less than ten nor more than thirty days after
receipt of said request and shall take final action on said removal
not more than twenty days after said hearing. If the person to be
removed shall fail to so request a hearing, then the removal shall
take effect on the date stated in said notice. A salaried person's
salary shall continue until said effective date or until such final
action is taken on said removal, unless a later date not exceeding
three months from the date of said notice is provided in said notice.
Procedures for removal of part-time, hourly-paid employees shall be
in accordance with administrative rules for such employees.
Members of boards, commissions and similar bodies
established by this charter shall be electors of the town unless otherwise
provided herein and shall be appointed to terms beginning on the first
day of January and expiring on the last day of December in successive
years, in such manner as shall be determined by the council in accordance
with the provisions of this charter.
The council shall have power to investigate
all town officers, departments, commissions, bureaus or boards, and
shall have access to all records and papers kept by each town officer,
department, commission, bureau or board, and shall have power to compel
the attendance of witnesses and the production of books, papers and
other evidence at any meeting of the council or any committee thereof.
At the request of the council, any judge may issue a capias for the
appearance of witnesses and the production of books and papers.
