Pursuant to Section 11 of the Uniform Fire Safety Act (P.L.
1983, c. 383), the New Jersey Uniform Fire Code (N.J.A.C. 5:70-1.1 et
seq.) shall be locally enforced in the Borough of Harrington Park.
The local enforcing agency shall be the Harrington Park Fire
Department through its Bureau of Fire Prevention which is hereby created
therein. The Bureau of Fire Prevention shall be hereinafter known
as the "local enforcing agency."
The Bureau of Fire Prevention established by §
173-2 of this chapter shall carry out the periodic inspections of life-hazard uses required by the Uniform Fire Code on behalf of the Commissioner of the Department of Community Affairs.
In addition to the registration required by the Uniform Fire
Code, the following non-life-hazard uses shall register with the Bureau
of Fire Prevention. These uses shall be inspected once per year at
an annual fee of $75.
A. A Assembly.
(1) A-1: eating establishment under 50.
(2) A-2: take-out food service (no seating).
B. B Business/professional.
(1) B-1: professional use, one- and two-story less than 5,000 square
feet per floor.
(2) B-2: one- and two-story more than 5,000 square feet and less than
10,000 square feet per floor.
(3) B-3: one- and two-story more than 10,000 square feet.
(4) B-4: three- to five-story less than 5,000 square feet per floor.
(5) B-5: three- to five-story more than 5,000 square feet per floor.
(6) B-6: three- to five-story over 10,000 square feet per floor.
C. C Retail (mercantile).
(1) M-1: one- and two-story less than 5,000 square feet per floor.
(2) M-2: one- and two-story more than 5,000 square feet per floor.
(3) M with the exception that hardware store 3,000 square feet and retail
store over 12,000 square feet are life-hazard uses.
D. D Manufacturing (factory).
(1) F-1: one- and two-story less than 5,000 square feet per floor.
(2) F: exception life-hazard uses.
E. S Storage S-1 (moderate hazard S-1; low hazard S-2).
(1) S-1: one- and two-story less than 5,000 square feet per floor.
(2) S: exception life-hazard uses.
F. F Residential (LEA listed with multifamily BHI). Fee is for each
building.
(5) R-5: each additional unit: $10.
Pursuant to Sections 15 and 17 of the Uniform Fire Safety Act
(N.J.S.A. 52:27D-206 and 52:27D-208), any person aggrieved by any
action of the local enforcing agency shall have the right to appeal
to the Bergen County Construction Board of Appeals.
Enforcement and violations and penalties shall be managed in
conformity with the International Fire Code, New Jersey Edition, N.J.A.C.
5:70-2.10 et seq., and all other laws of the State of New Jersey as
may be applicable. All fines collected shall be deposited to a dedicated
account for the purpose of funding the enforcing agency, as the same
may be permitted by law. The funds not allocated from this account
by the Mayor and Council for the enforcing agency shall become part
of the general fund of the Borough.
